EEA4 Application --- HELP HELP

Hello,
After several complaints letters to the UKBA, i have now received a letter from our caseworker to forward our passport back to them.

January 2009 made application for permanent residence card on EEA4 for myself and my mom and my wife on EEA3

April 2009 We requested to have our passports back as we needed it for job applications.

August started complaint as my application is over 6months. Last week received letter from caseworker for us to forward our passport. My wife, myself and my mom for permanent residence stamp.

My wife is now reluctant to send her passport in since we have been arguing lately. We are still together though and have a lovely son.

What am i supposed to do, will my application be rejected if i dont send hers in? PLEASE HELP,

Have you evidence she was exercising treaty rights up to the five year mark and that you were living together.

You automatically gain PRC after 5 years stay in the UK with your EEA partner.

Therefore you can notify them that you are unable to provide her passport and provide other evidence.

We are still living together in the same house, we have not been seperated. I everything to the home office at the time we made our application back in january 2009. She just doesnt want to give her passport because we have been arguing alot lately but yet living together. So what are my options.

The following documents must be supplied by a non-EEA national family member of
an EEA national who is applying for a permanent residence card under Regulation
15(1)(b) of the 2006 Regulations having completed 5 years residency:
• A valid passport
• Proof that s/he was a family member of an EEA national during the 5 year
period
• Documentation confirming that s/he has resided in the UK with the EEA
national in accordance with the 2006 Regulations for a continuous period of 5
years; this requires confirmation that during this period the EEA national was
residing in the UK in accordance with the Regulations .

Therefore a marriage certificate and her payslips or bank statement and utility bill in both your names will suffice for this purpose.

Please note that the valid passport applies to you and not the EEA national.

Well at the moment i've only been asked by the caseworker to submit all our passports so i'm just going to send mine and my moms to him and include a cover note that my wife is being reluctant because we have recently had arguments and she has refused to include her passport. how about that. i think i do have a strong case though.

try to convince her as she will be letting you down most of thetime when they request doc. decision is already made its just stick your confirmation of PR.
what you can do is to send a certify copies of her passport and tell your caseworker that your wife will be travel soon.
