Second Extension & ILR Query ? senior member please repl

Post by fahadz1 » Sat Sep 05, 2009 4:31 am

HI All and Seniors members,

I am reading the word 2nd extension in the forum.

What is second extension ? How one can have 2nd extension ?

as ILR rule states no more than 6 months in total in 5 years period.

for example ?
IF a person is out of country 9 months in 5 year period so he/she have to take 2nd extension for 3 months ?? is this called 2nd extension ? if yes then do he/she need to provide again 12 months earning and off course no age points will be given ?
and after 3 months he have to apply ILR ??

is that all about 2nd extension ?

can any one give reference UKBA website URl for this ??

Thanks

A quick example which I think might help.

Lets say a person received his Tier-1 Approval in Jan 2009 but did not entered country till May 2009. Now as soon as he enters the country his timer for ILR starts. But since he has entered country 5 months late, he will have this 5 months gap at the time his first visa extension expires.
Hence second extension.

The length for which you will need another extension will depend upon how short are you on the ILR qualifying period (factoring in the unauthorised breaks).

thanks for reply chetan. so it mean he have to apply again for 2nd extension by claiming points ??
i dont think any one get points for age for 2nd extension ?

according to ur example? he will be in country for 4 years and 7 months.... then he need 2nd extension ? n if he unable to claim points he have to go back home while having HSmp VISA and staying 4 years and 7 months on HSMP ?????????

secondly i dont think every one arrive on the date visa is issued or visa is started ?

let say a person is arrived after 7 days of date of visa started. and in 5 years he is out of country for exactly 6 months ? so he have to need 2nd extension for 7 days remaining to cover his 5 years on HSMP ?

is there any UKBA website which states this and all detail info regarding 2nd extension ?

i was in UK when i got HSMP.

so u mean to say i have to be out of country for maximum of 6 months in my 5 years of HSMP right ?

for suppose i am out of country for 7 months so do i need to another extension to cover my 1 months to complete 5 years?

You are allowed to stay out of country for certain period. 180 days in this case.

But, you are confusing here between completing 5 years in UK and time you are allowed to stay out(which is only after you first entered the country).
