Applying for Tier-1 from within the US

Hi,

I have an expired H-1B visa from my old employer, but a valid I-797 and an I-94 from my new employer.

Can I apply for my Tier-1 visa from within the US?

Do I need to send my I-797 along with my passport (which has my expired visa stamp as well as my current I-94 (valid till 2011).

I do not think that they ask you to send these along with your application. They just ask, have you ever been deported from UK?

You just need to send docs as proof for the points u r claiming for like
Educational, Earnings, Age, Maintenancefunds, Englishlang etc..
others not required.
