In case the primary holder is not traveling with dependent

Post by jhajharia1 » Sun Sep 13, 2009 6:45 pm

Whats the locus standii in case the primary holder is not traveling with dependent (when primary is outside UK) ? assuming that they have already made 1st entry together on HSMP/Tier1 and this for 2nd time and onwards !
What all documents does the dependent needs to carry with her/him!

"locus standi" - roughly right to sue, appear or bring a case before the court?

What exactly do you mean in plain English?

I simply mean where does the person stand in terms of immigration rules.

Grounds on which leave to enter or remain which is in force is to be cancelled at port or while the holder is outside the United Kingdom
321A. The following grounds for the cancellation of a person's leave to enter or remain which is in force on his arrival in, or whilst he is outside, the United Kingdom apply;

(1) there has been such a change in the circumstances of that person's case since the leave was given, that it should be cancelled; or
The entry clearance could be cancelled due to a change in circumstances in the worst case scenario.

It would be difficult to justify a dependent living in the UK if the main applicant does not and does not intend to for example.
