Tier 1 General – Qualifying period of stay in the UK for e

First post, so please be gentle.

I’m in the process of relocating my family (wife and twins) to the UK under a Tier 1 General arrangement. Once in the UK, I expect to be self employed.

My dilemma is that by virtue of my occupation; a development consultant, I work assignment to assignment, constantly travelling in developing countries, and rarely in one place for more than a few weeks.

Although my family will be in the UK, and I intend to have clients transfer my payments to the UK, I doubt I will actually be in the UK for more than 8-9 weeks a year.

Can someone please help me understand how this setup might affect my Tier 1 extension, and eventually my ILR application?

Would you also be kind enough as to please shed light on how my overseas earnings will be treated. Will they count towards the points needed for the Tier One extension?

Its a big decision for you. You might want to wait till the new immigration rules and guidance come out

In response to your PM - pls see Part 2 Para 39 onwards of the new Act. Now this is the Act. HO will release rules and guidelines under the act in due course.
