Uurgent advice needed, visa expired

I am new to this board but have been looking through everyones posts for preparing my wife's ILR application. Unfortunatley, we have only just looked at her visa and it shows as valid until 11/09/2009. She entered the UK on 5/10/07 which made me think she still has time so i never checked the visa.

She has passed her Life in Uk Test. And we are now desperately trying to get her documents together for the application. Any advice on how the home office will look upon this application. It has been a genuine mistake.

Should we submit the application with a letter explaining what has happened?

Any help or advice will be really appreciated

I think you might *just* get away with it - 2/3 weeks for genuine mistake is ok but if I gets to a month or so tho it might be rejected...

Yes get in there quick with an explanatory letter. Remember you only need 6 documents from different sources ranging over a period of two years.

I have known one person being refused for sending it 4 weeks later.

Therefore by next week it should be with the HO. Send it by the fastest special post you can buy. After that keep your fingers crossed and start praying

Fastest post is Royalmail next day delivery before 9:00am.

Some couriers also offer same day delivery too :lol:

Don't send it by courier. If you send it by Royal Mail special delivery the HO will take the posting date as proof of application. The envelope will be kept in your wife's file. Courier delivery doesn't have the same evidence of dispatch.

Thanks for the replies. I have pretty much everything ready. Just going to organise the papers and get it sent this afternoon.
