Pls Help Me About 4EUFAM

Hi.Everybody.I m new in this form.I am Indian National and got married with my EU spouse in december 2006 and got 4EUFAM in 2008.But this stamp started from June 2007,straight after 6 months i got the merrage.That 4EUFAM stamy will expire in June 2012.But the problem is things gone very bad with my EU SPOUSE and getting werse.We are thinking for separation.And she really want separation, I just wanted to know,will it affect on my 4EUFAM stemp.And after how many yeras if we separte or Divorse ,i am ligelly safe in this country.Even we were not spouse anymore.Pls answer me as soon as possibel if anybody have any information. The article 13 is too complicated for a new person on this forum as legal terminologies are references to many articles are used
please help this guy in simple words and answer his question.

Hi there,

I will try and explain to you in an Irish context and hopefully you will get the gist.

I’m an Irish man and living in Ireland I married an Indian woman in Ireland in 2006, after 2 years and 2 months, we split up. She wasn’t in a rush to answer my solicitor’s letters for legal separation, so now I’m seeking Judicial separation (very exp) through the Irish courts. She cant ignore this process. Her visa expires in November 2010. I will have my legal judicial separation by March or April 2010.

I have spoken with dept of justice, GNIB and also with the new section “spouse of a Irish national sectionâ€

ok, as far as i know if you and your wife lived together as huband and wife for three years since you got married your permanent application for residency will not be effected and if you did not live for 3 years then it is up to the minister to decicde based on your own criteria.

You are obviously talking about Irish law while the OP made it very clear that he/she is in Ireland under European law. In that case the requirements are three years marriage in total and one year in the host member state. The OP must also be able to support him/herself. Only then will he/she be able to retain right of residence under EU law.

Guys, please make it clear for me, the 3 years living (as husband & wife) together on the bases of EU spouse, start counts from date of marriage or from the date of Stamp 4EU FAM.

Hi Guys,
In my particular case and Im sure its same across the board here in Ireland. It starts from the date of the first stamp 4 in the passport, which in normal situations should follow soon after a marraige.
