ILR for uk born child. No PEO application for hsmp ILR!

ILR for uk born child. No PEO application for hsmp ILR!

am applying for our ILR under hsmp JR ruling after a little over 4y under hsmp. i have 1+4 hsmp visa valid till mid xxxx (but been in the uk since 2nd half of xxxx under PFT prior to hsmp). my wife has hsmp dependent visa with same expiry date as me. we have a uk born child of 11months who has never been out of the uk, we have a indian passport for her (issued in the uk) but didnt apply for a hsmp dependent visa as was applying for our ILR and knew didnt need to apply for a dependent visa for child if child was not leaving/re-entering the uk before we get ILR +/- child subsequently getting registration under sec1(3) as a british citizen. been eligible for a few months to apply for ILR but havent been able to apply due to various reasons.

just a few queries regarding ILR applications.

1.rang up phone number yesterday for booking PEO appointment for our (me, wife & child) ILR applications. recorded message says no slot available for august. waited for person to answer and they say they are not giving any appointments for PEO even for later and to only apply by post and they refused to say when slots will be available anywhere in the UK at PEO offices. is this a new development about not allowing PEO applications for ILR? have they stopped PEO applications for hsmp cases now?????? no mention of this on website but the phone helpline chap refused to give any slots saying no slot available for august and they are not giving any slots for later.

2. i enquired about applying for ILR for my uk born child (11months old now) who has never left the uk about whether to apply for visa first for child then apply for ILR for all of us or apply for ILR for all of us directly or apply for ILR for me and wife and apply for registration as british citizen for child directly under sec 1(3) of registration rules after we the parents get ILR.

initially the person on help line said our child is staying illegally in the uk even though uk born as has not applied/got for a uk visa for many months, also was told by the helpline person that generally need to get visa in 2-3months after birth in uk although i cant find ANY documentation for his claims about stay becoming illegal if dont get visa for uk born child on the UKBA website on this issue of needing to apply withing 2-3 months of birth of child in uk. infact i found documentation to the contrary on UKBA website which said the stay was NOT illegal and an application cannot be insisted upon or a period of stay be imposed if there is no application.

3. i explained born in the uk and never left the uk and not illegal as per my knowledge of rules and visa application needed to enter the uk and not complulsory for person born in the uk who never left the uk.

then he said to apply for visa for child first as they wont give ILR without visa on passport. i explained we the parents are applying now for ILR as we have been eligible for a few months anyway and child is under 1y and have been busy with few hospital visits/admissions for wife and child and hence didnt even apply for ILR even though eligible a few months ago but visa still valid for us till mid xxxx. then he said can apply for ILR directly now quoting reasons for delay in not applying for visa for child in covering letter for ILR application as child will be my dependent and case worker will decide whether child is eligible for ILR without having dependent visa stamped on babys passport.

4. i further explained to helpline person, even if a uk born child of non EU parents didnt have a visa, once we the parents get ILR of our own merit soon (i dont anticipate any probs as have satisfied all requirements as per my knowledge) then the child will then be ENTITLED under section 1(3) of the British Nationality Act 1981 to be directly registered as a citizen anyway. so asked if i have to apply for ILR for child or to directly apply for citizenship instead for child after we get ILR. he said cant advice on citizenship applications as that is a different department and to TRY for ILR application for uk born child as my dependent but caseworker will decide whether to grant that as there is no valid visa stamped on babys passport before applying for ILR.

5. has anyone on here directly applied for a uk born child (who has never left the uk) for ILR without getting a dependent visa stamp. is it compulsory to get a ILR stamped for baby when we (me & wife) apply for ILR, since i plan on applying subsequently for childs registration under sec1(3) as a british citizen by using form MN1. as i under stand i would be spending more if applying for registration of child soon after we get ILR instead of waiting for applying along with our naturalisation application a year after ILR. but i think it would be better to get the childs registration done now before any hurdles throw up in the proposed citizenship legislation.

6. once the child gets registered as a citizen and gets a uk passport, i guess i can avail free travel rights in the EU for tourism purposes without need for schengen visas etc for family (me and my wife)of EU citizen (our child) or is this directive not been enforced properly yet for family members in the ascendent line (parents who look after minor EU citizen)

7. does the chen case give free EU movement rights for work elsewhere in the EU to the non EU parents (with ILR in the UK) of a UK born and registered child. just enquiring about this because of the recession and possibility of redundancy etc. just enquiring about this option to keep myself updated on this front and not actually planning on using this option as job seems ok for now and shortage presently in my field of work in uk, but one never knows what the future has for us so just keeping my eyes open for new developments on these fronts.

8. for our hsmp 4y ILR application, for establishing economic activity do we have to provide bank statements and payslips for all 4y on hsmp or is a shorter period ok. if its for 4y then my application packet will be huge. hence the query. forgot to ask this when i called helpline today after getting 'seemingly wrong' advice from them about my childs residence status /ILR eligibility etc

i have been through the following links on UKBA website which confirm that it is not compulsory to apply for a visa for a uk born child of a visa national.

CHAPTER 8 CHILDREN BORN IN THE UNITED KINGDOM
SECTION 4 WHO ARE NOT BRITISH CITIZENS
1. INTRODUCTION
This section relates to children born in the United Kingdom on or after 1 January 1983 who are not British citizens because, at the time of their birth, neither of their parents was a British citizen or settled here. Such children do not have the right of abode and are subject to immigration control. They are not here unlawfully, however, and are not required to apply for leave to remain
and also WHO ARE NOT BRITISH CITIZENS - ANNEX P from the same document. see relavant extract below
12. POSITION WHERE NO APPLICATION IS MADE FOR LEAVE TO REMAIN IN RESPECT OF A CHILD BORN IN THE UNITED KINGDOM.
A period of leave cannot be imposed upon a child where no application has been made for it. Consideration can only be given to a child's position here, therefore, where there is a specific application for leave. While it cannot be insisted upon that an application be made on the child's behalf, if it appears that he would qualify for leave (for instance, following consideration and granting of an application for leave to his parents), the situation should be explained to the parents so that they may decide whether or not to apply on the child's behalf.
since it says in annexure p that they cant insist on an application from an uk born child of a visa national and also cannot impose a period of leave without an application, does this defacto mean that the child has an ILR all but in name! i am just wondering about this due to the seemingly wrong advice given to me by UKBA helpline yesterday in stark contrast to what is available in written documentation on UKBAs own website on this issue. ofcourse it isnt as good as an ILR as it would be void once the child leaves the uk. i have downloaded and printed copies of the relavant paperwork about this issue from ukba website just incase it disappears later from the website. others in similar situation might find it useful to do the same print outs and keep for future use as well.

Vinay Santhi Have you applied visa for your baby, if so could u please let us know what r the requriments, as i am in the same situation as yours my baby is 13 months old, born in uk and never been out of the country.



Could somebody please reply to the above question? What supporting info can we supply to Home Office when they question us about baby visa status as I am planning to apply her visa with my ILR.

sorry for the late reply. hadnt seen some of these posts asking for feed back till now. have replied to a few who sent private messages regarding this.

anyway...

I got ILR for me and family without any problems. i applied by post. i am pasting a copy of my covering letter in case it is of use for others in a similar situation. ukba didnt contact me for any further info, they used the info i provided and gave us ILR. my wife had the same ref number as me but child had a different ref # probably because my childs application needed referral to senior case workers etc. applied around 23 sep and got visa back around 7-9th nov. got retrospective ILR effective from the date i completed 4y on HSMP.

That document originally had the mar 07 version on the UKBA website. i had enclosed a copy of that with my application. but on checking today that document seems to have been replaced on the UKBA website with a nov 09 version. some points seem to have been clarified in the new version. but please note that this version is different from the old version. i have both copies as i make it a point to keep printed and electronic versions of all documents relavant to my needs as i find that UKBA documents keep changing or disappearing sometimes to my detriment, so just got into the habit of saving and printing all documents on ukba that is of use to my needs.

I and my dependents are applying for indefinite leave to remain under the therms of the HSMP ILR judicial review policy document. I have enclosed my completed application form and supporting original documentation, passports and payment details. I am applying for ILR after 4y on HSMP visa. I have been in the UK since xxxxxx initially on postgraduate doctor visa and then on permit free training visa and then got HSMP visa on xxxxxx while in the UK. I am only applying for ILR using my 4y stay under HSMP and not my prior stay under other categories and have hence provided finance documentation for the HSMP period.

My dependent (delete as applicable) son/daughter xxxxxx(include here the full name as in babys passport)xxxxxxxxx was born in the UK on xxxxxx. She/He(delete as applicable) has an Indian passport issued in the UK. She/He(delete as applicable) presently does not yet have a dependent visa stamped on her/his(delete as applicable) Indian passport as I hadn't applied for one for her/him(delete as applicable) as she/he(delete as applicable) had not left the UK since her/his(delete as applicable) birth and we were applying for ILR. I was aware of documentation on the UKBA website which clarified that applying for a visa for UK born children was not mandatory to continue to stay in the UK. I quote the relevant documentation on UKBA website and enclose a print out of the same.

In view of the above documentation on UKBA website and also being aware of other similar cases I had not applied for a dependent visa for my UK born child as I was applying for ILR for all of us anyway. In my ILR application I have also applied for ILR for my (UK born) daughter/son(delete as applicable) as my dependent.

Soon after us her parents get ILR we will apply fto get our daughter/son(delete as applicable) registered as a british citizen under sec 1(3) of the British Nationality act 1981. I quote and enclose a print out from http://www.ukba.homeoffice.gov.uk/briti ... /borninuk/
If the child's parent has become settled in the United Kingdom or becomes a British citizen, the child will have an entitlement to register as a British citizen. This registration would be under section 1(3) of the British Nationality Act 1981.
All my supporting documents are originals. Enclosures -
  • My Indian passport xxxxxxx and also my old passport xxxx
    My wife's (name) Indian passport xxxxx
    My daughter/son's (name) Indian passport xxxxxxxx
    2 of my photos with name written on the back of the photos
    2 of my wife's photos with name written on the back of the photos

    8 months bank statements + cash ISA 6 monthly statement

    52 consecutive payslips covering the duration of my stay on HSMP and a short while before it. For the month of xxxx in the year xxxx I didnt get my usual payslip by internal hospital mail as was on annual leave. I have subsequently got a duplicate issued of the same month payslip, signed and stamped from the hospital payroll dept and have enclosed that.
    Letter from employer stating salary and that in permanent employment.

hope the template is helpful for a few in similar situation as i was in. i sent my application by special delivery. in bigger post offices for special delivery they give special delivery plastic A4 size envelopes which are strong. i used that as my documentation and passport was almost 680-700g, i was worried the package would split and lose my documents if sent by paper envelope so used the special delivery envelopes (which is only available in some bigger post offices and not all, in the rest of the post offices they just charge the same amount but ask you to use your own paper envelopes). from past experience of some friends and others i knew who lost passports / documents at UKBA, i didnt want to endure the same so sent it in plastic envelope as UKBA wont be able to use excuse that they got envelope but not documents like they told some i know when they 'lost' the documents internally.

i guess i didnt need to send all the documents that i did send, but i thought better be safe than sorry and sent a few more than needed.

i mentioned the BNA sec1(3) in my covering letter to avoid the situation of my friend who got renewal for him (hsmp 1+3+3) and wife and one child but another uk born child (one year old!) got refusal of visa extension and deportation letter due to some deficiencies on applicants behalf. but later this friend on applying for review got visa for that child as well. they gave deportation notice to 1y old uk born child even though that person was eligible for ILR but had applied for visa renewal as the ILR judgement wasnt implemented yet then. To get around a similar problem in my case i deliberately mentioned the BNA sec1(3) to make case worker aware that child will be entitled for registration as uk citizen even if they reject ILR application for child when they approve my application. was just covering all my bases by writing a LOOOOONG covering letter.
