min time to apply ILR for Ukranians citizens criteria?

Post by pakstar » Wed Oct 28, 2009 12:40 am

Hi

Two tricky questions for gurus :)

First : My Mrs is from Ukraine and she living with me nearly 3 years being student dependent and now Tier1 PSW Dependent. can she apply ILR UK after another two years making total 5 years of residence in UK? that was first question

Second: I am living in UK for 5 years now on student + tier 1 PSW visas, If i change my nationality to Ukranian which I am eligible for; can I apply for ILR UK being a Ukranian citizan, livin in UK for 5 years... or my 5 years time to be eligible for ILR
(as for Ukrainan citizen) will start from the day I will change my nationality to Ukrainan?

Thanks for your help in advance.

  1. Your wife can only apply for ILR when you apply for your ILR. It looks like that will be when you have been on Tier 1 for nearly 5 years.
  2. Your change, or addition, to your nationality will make no difference to when you can apply for your ILR. It is simply not an issue as regards your ILR application.

I answered this but it was moved and my post went!!

Anyway;

You need to get ur self on Tier 1 or 2 for 5 years ILR, student visa time and PSW only count toward 10 year legal stay for ILR.

It's not possible to gain Ukrainian Nationality without living there (three or five years, cant remember) with your wife. Also bear in mind Ukraine does not allow dual citizenship and if you did somehow nationalise, I think u'd have to serve in the army if under 28 yo..

Ukrainian citizens don't get ILR after five years, dunno where u got that from.

I have my friends in Ukraine who are now Ukranian natioanls but they never went to army. People get ILR in UKraine after 6 months of marriage and Ukranaian passport; one can get after two years of marriage or after one and half years if you have child.

will double check 5 years or 6 years law.. maybe if you ahve two childern born in UK and you living over 5 years you can apply on human rights ground or something?

thanks
