Hi everyone,

I'm in a dilema and would like to ask for peoples second opinon.

I hired an immigration lawyer back in the UK to help me fill out my Fiance application to UK. Originally we filled out a VAF1F MARRIAGE VISITOR visa. I took the finished packet to take back with me to america to apply. Day before i flew back to america, I went online to look up the final fee for the application form he gave me, i looked under VISITOR FOR MARRIAGE (because that was the description on the application) and it cost £67 i thought, this isnt right i thought it was £585...so i look for the one that is £585 which in the settlement category under FIANCE(E)/PROPOSED CIVIL PARTNER. Suddenly some questions about the vaf1f start to seem clear...on this form it asks how long i plan to stay in UK, when i plan on leaving the UK, if someone pays for any part of my visit who will it be, who is paying for my expenses such as food , etc - i thought, what that doesnt make much sense because i dont want to leave the UK and im not there to visit.

So i download the VAF4A form online and this one does not ask when i plan to leave, it lets me file under the fiance/proposed civil partner category amongs others, its long and asks more personal questions like how we met, asks about divorces we have if any, children involved his/mine/ours, and most importantly that it is a settlement visa, because i want to stay in england.

My lawyer emailed today and said that the original is the correct one and the vaf4a is not..he tells me this now! Well i have all the supporting documents required for the vaf4a ready , just waiting for damn postal strike to end in UK so my fiance can post the rest of the documents to me. So i sould be covered for both applications..just confused about which one i really need...i have doubts.

Can anyone concur with me?

So my situation is I WANT TO GO TO UK AND MARRY MY FIANCE, AND ONCE MARRIED I WANT TO STAY U.K. AS HIS SPOUSE WITHOUT HAVING TO LEAVE THE U.K. AND GO BACK TO AMERICA TO RE-APPLY FOR AN EXTENSION. (FLR i think)

Which one do i need 100% for my situation, VAF1F or VAF4A??

soo confused,scared , im also asking another lawyer for second opionion...vaf1f doesnt feel right for my situation.

Read above link. It gives you the guidance and requirement for a fiancees visa.

You will need FORM VAF4A ,if after marrying your fiance you WANT TO SETTLE IN THE UK permanantly.

The fee for that is £585.

My fiancee in the UK (I'm in the US) contacted someone there who told him I should fill out the marriage visitor VAF1F application. However, I plan to stay in the UK after our marriage. The marriage visitor one was denied for a couple of reasons, which we are preparing to address and provide better documentation for. One of the reasons was because this visa was only good for 6 months, yet he had been told that I should apply for the marriage visitor visa then apply to extend it once I was in the UK and we were married.

Before I reapply for the visitor visa, I need to know if it's even the correct one. Or should I be applying for the VAF4A instead?

I'm contacting a lawyer in the USA who deals with uk immigration law only, and nothing else. My fiance is also getting a call back on monday from an immigration advisor at workpermit.com (this site) He phoned the number at the top left corner on this page, london office... I'm waiting to get this confirmed 100%

That was extremely helpful!

So instead of reapplying for the marriage visitor, I'm thinking I should apply for the fiancee one. But I'll wait for more information. It is very confusing.

Ladies if you go to the link I have posted above, it clearly states that you need form VAF4A.This form is used by spouses, fiancees or civil partners.

I cant believe you are still confused after reading the above link :roll:

oh i totally missed that!! thank you ! i see it now..im copying and pasting it to my lawyer, its plain and clear - i wonder what the odds of getting my money back are :oops:

Visitors may not switch. However, immediately after marriage, Fiancé(e) visa holders may switch.

My apologies, I did check out that link. My confusion mainly stemmed from the fact that, as I said, someone my fiancee had spoken with in the UK (can't remember the name of the agency) told him I needed the VAF1F. I'll be applying for the VAF4A this week.
