important and tricky..ILR AND CHILD TAX CREDIT

my friend is sceptical about her husband's application for ilr set(m). the reason is:
1,will the home office check whether her husband is claiming child tax credit?
2, will the they run the same check on her?
3, becase she added her husband's name as a joint claimant after 8 months of their marriage,can this affect her husband's ilr application or will the home office use a discretion on this as a spouse of someone settled in the uk more importantly as child tax credit is not classified as public fund for this purpose.


can anybody please advise.

please dnt be crossed if she has asked the question too cos i ve introduced her to this forum as well.

that should be no problem as long as one of the applicants are have permanent residence or are british

ok are we saying that should be no problem or we cannot imagine. i am of the opinion that a family should not be seperated because of this issue as the applicant ha not made recourse to public fund.
can we have more opinion on this please anybody

If the wife is a BC or has ILR then it's fine to claim tax credits so long as both partners earnings are declared on the tax credit claim form.

Personally I feel it's fine to separate families if immigration law is being broken, why not? Heartless maybe but the alternative is the freedom to abuse again and others to abuse in the same fashion.

now in this case where the family income was declared late,as in after like months after living together, is that going to be an affecting factor for the ILR to be refused.
