Mother's VISA refusal-and Appeal

Hello,


My mother visa was refused today with following reasons..


1. Bank statement is older than 3 months
bank statement was fresh at the time of application (applied on 4th April 2009 and decision date was 30 Oct 2009).... we were asked to resubmit the biometric on 7th of September...and meanwhile nobody requested the updated documents the guy at Gerry's having Biometrics again refused to take fresh bank statement and new property evaluation certificate as he explained that the decision would on the docs attached to application and no need to provide anything new until unless requested

2. Not strong ties in Pakistan

We did not submitted any property or other related documents as it was not required last time


Now in this situation what should we do..

Reapply or appeal?..

She is already quite stressed as this process took 8 months already but on other side we submitted 5 year’s visa fee

new application vs appeal

Hi

what i have understood is that appeal takes longer but u have got a chance to explain ur circumstances in front of a judge in oral hearing but in fresh application its still going to b the same ppl and more likely to b refused cuz they can come up with any excuse to reject the application as this is whats been happening cuz so many ppl have got rejections.its their way of making money and causing distress.

Thats not true all the times.Most of the times its an ill and hastily preared application without the proper documenst being provided to give teh ECO a chance to make the decision on the balance of probalities. :roll:

Will we get an advantage for ECM review? As the application was delayed to almost 8 months and the doc were old at the time of decision due to embassy delaying the decision..



What do you think will they acknowledge this?

You will only get ECM to look at if its done officially by completing the appeal notice form.

If you jsut write a letter to him, he wonet even bother looking at and will stick to the original decuision which is basically a refusal and can only be changed by way of an appeal hearing at AIT.

That will take 6 months for a hearing and then add a further 3 months to get the visa stamped ( that is providing you win the appeal)

If you want a quick turnaround, just re-submit the application with all the necessary up to date documents (which could take a few weeks - at most!)
If you have enough time on your hands, not to mention 'patience', then go for the appeal (which could take agezzzz!)
