i had a child with another woman 4 years ago and kept this relationship secret from my wife a the time. Now i am divorce and started living with her and she's expecting a 2nd baby from me we planning to marry soon.

she's illegally in the UK since arriving she sent an application to the HO on a compationate ground as she fled her country because she was facing a genital mutilation trhis was 1 year ago.

the HO recently sent a mail to her requesting some infos before deciding her case they also sent a form about her entry in the country.

i would like to know if i can help her in anyway (i am british citizen) and our children will also be british.

can anyone help?
thanks

Has the first child who is 4, started attending school?

On what basis did she apply for compassionate leave?

hi obie
the first boy is attending nursery since last year and i am about to register him as a british citizen.
the compationate application is on a basis of her being part of our family and being able to enjoy her family life.
also if she is retourn home she may face a genital mutilation as she will be force to marry someone her family will choose.
thanks

Once you are married, she could apply for FLR under Chikwamba, as you both have a British child, attending school in the UK, whose life would be disrupted, if mum were to take him away abroad to apply for a spousal visa.

I am not quite sure about the likelihood of success of the compassionate leave. Did she apply as a partner in a durable relationship with a British or Settled person? if so, did you provide evidence that you have been living together in a relationship akin to marriage for a period of 2 years or more?

You mentioned you are about to get married, have you applied for COA, and were you successful in obtaining it?
