turn down on EEA-FP

was turn down on my application been that i used the EEA family permit, i legally married to a British and i am planning to live permanently with my wife in UK . on the ground that she dont execise the treaty right in my eu state where i live before returning to the UK. so apprently is not the EEA FP
we are newly married about 2month ago but we have been in contact for very along time before our marriage.

1 what application should we apply for now? is it Settlement ‘‘husband’’ , from the online application.?
2 what documents is needed?
3. The refusal i got should i appeal or forget about it and go straight in applying for the Settlement ''husband'' (spouse visa) now?

If not eligible for an EEA family permit, then you may apply for a spouse visa, subject to the Maintenance & Accommodation (MAA) requirements.
