Peggy, welcome to this Board. If you look at this IND webpage, and then scroll about 40% of the way down that page, there are some indications of service.

You say you applied in September and as luck would have it that page says :-
European Residence Permits/Documents September 05
-: that is, there are now considering applications made in September.

So hopefully you should not wait much longer.

Peggy, are you working in the UK? And your husband is he needing to get his Residence Permit in his passport before he can work?

If you don't mind me asking, on what basis did your husband get into the UK? That is, what type of visa does he hold at the moment?

Peggy, sounds like a very good plan. Hopefully you will hear soon.

One thing not to worry about is whether your husband's residence permit is in his passport by the time that the student visa expires. Because of legislation commonly known as "Section 3C", the student visa is "treated as continuing" even if they have not dealt with the new application by the stated expiry date of the old visa. That is, your husband would not become an overstayer simply because IND have not dealt with the new application on a timely basis.

But for obvious reasons you want to hear soon.

More about Section 3C by clicking here.
