****** Urgent Help Required on Tier 1 :*******

Post by roopscisco » Fri Dec 11, 2009 9:21 pm

Urgent help required as one of my friend applied for Tier1 in Oct 2009.. Got refusal letter today. This is his circumstances.

Hes going to have his graduation ceremony in Jan 2010

He has provided a letter from Uni & in their letter head stated he has completed his studies, but Uni has not mentioned the date of the Graduation ceremony. HO did mentioned this is the reason for rejection.

He can talk to Uni to get them to issue the letter again with the definite dates on it.

But he was on Student Visa & its expired now.

Can he stay in UK & be able to appeal?

Can someone advise please /

Thanks.
Roopscisco.

He must have given right to appeal within 28 days. I think if he can get letter from University with proper dates he should be fine. Though I am not sure, if graduation ceremony has happened why he did not have actual degree in hand.

I would advice to go via solicitor who can defend his case properly in appeal.

Hey thanks for the reply. Yes, as said you he got the right to appeal. Also his graduation ceremony has not happend yet. it will be mid of Jan 2010. But Obiviously, he can get the letter from Uni with the actual dates on it. Thats not the problem as this is a genuine case. but he was just wondering whether has needs to go back to his country as he doesnt have the right to live here now.

So i understand that from here, he saty here for until the decesion is made for his appeal. Is that correct ?

Thanks.

He has to appeal within certain time limit. Once appealed, he can stay in the country untill decision is made.
