Regularizing Child's residency

Post by timm » Mon Dec 28, 2009 9:08 pm

I am in the UK on HSMP.

I had a child while outside the UK, and came back to the UK with the child with a UK visa as the child does not require a visa to visit the UK.

I was however told at entry, the child ought to have obtained a visa as is to be treated as residency as the child is coming to reside in UK as I am resident. The child was then issued a temporal stamp at entry valid for 6 months and I was told to rectify it before it expires.

What does this mean and what do I need to do?

Can the child travel out of UK (for a short trip) and return while the current stamp is still valid?

Would a new one be issued should the child travel out of UK?

Thanks for your help. Much appreciated

You have posted insufficient detail .... about yourself .... the parent of the child! Simply, your UK immigration status. You say you are on HSMP. When does your current visa expire?

It is not recommended that you remove the child from the UK, before you sort this out properly because, well, what would you do if the child is refused re-entry to the UK? Ouch!

Thanks John,

I have obtained FLR on the HSMP and my residency permit expires June 2011 .

However, I would be four years (and due for ILR) in June 2010 and fall under the judicial review.

The six months I am given to regularize it expires before I am due for ILR.

Your assistance is appreciated.

The stamp in your child's passport, when does the 6 months expire?

And your ILR, are you saying you cannot make that until next June? Or possibly some time in May, given the 28 days leeway?

Just trying to see if it is possible to save the extra fee through needing to make an application in the next week or two.
