failed asylum seeker

Post by ingarather » Sat Jan 02, 2010 7:17 pm

I am a 23 yr old female and i came to this country when I was 14yrs old to visit my mum on a 6month visa. During my stay i started school and i never returned home. All I knew at that time was that i was coming to visit my mum and i did not know for how long. Before I came here i had not seen my mum for 10yrs.After a few months of staying with my mum she left for Belgium with her boyfriend and never came back.

My aunt took care of me from that point on, I also lost contact with my dad in Zimbabwe as the only contact i had with him was through my mum.

I finished my "A" levels in 2005 applied for university i got accepted. That is when i found out about the situation with my Visa. I could not enrol at university because I was an over stayer and my Visa had expired. unfortunately when my aunt finally decided to renew my visa as her dependant i was already 18 and 2mnths making me an adult, my application was denied.

I saw my dad again here in the UK when i went to the ZIM vigil with my aunt. My dad is am MDC supporter. I started attending functions with him, babysitting supporters kids and taking on other roles.

In 2006 we went to court to try and get leave to remain on Article 8 but was denied as i was 18 and considered an adult, even though all my family is settled in the UK, my step mum dad, my brother ,sister all have indefinite live to remain. The only family i had left in Zimbabwe pasted away last year my dad's sister moved to the US i have not family left in Zimbabwe.

Due to my dad's political views and my participation at MDC functions my life will be at risk if I go back to Zimbabwe. I decided to claim asylum in 2007 and failed the interview. We went to appeal the decision in 2008 the court did not argue that i was a bonifide supporter but the case failed on credibility.

in march 2009 I put a fresh claim using case laws including the RN case. is this case still valid??????????. It has been 9mnths and i have not heard from the home office.

I have been in this country for 10yrs,I am not able to apply for on the 10yr rule since it has been changed to 14yrs.

I have not been able to attend a lot of universities because of it and now I am finally going to college to get a qualification in Business Management

I DON'T KNOW WHAT ELSE I TO DO. IF I AM SENT BACK TO ZIMBABWE I WOULD NOT KNOW WHERE TO GO, OR WHERE TO START FROM.

my family is here.

HELP ME SOMEONE PLEASE

THANKS
