Hi to all and thanks so much to all the contributors on this forum. I've been scanning this forum as well as the UK Border Agency Website and phoned the London office but am still confused.
I'm a UK Citizen, Australian Citizen and a USA resident. My husband of 7 years is an Australian Citizen and USA resident. We married in Scotland. Ideally we'd like to spend 6 months in the UK and 6 months in the USA and I'm wondering if this may be a problem for UK immigration. Nearly all of my family are in the UK and we'd like to be closer to them.
We've been in the USA for 18 months. We haven't worked in that time as we sold our business in Australia and didn't need to work. We have property and savings that can keep us quite a long time but wonder if not working will have an impact on my husband's application to the UK. We own a property in Scotland. My husband would want the option to work as we may buy a business, work in it half the year and put it under management.
Can my husband apply for ILE or ILR, not sure which one is correct. Can that be done online? We'd ideally move in May. Any idea how long the application process is?
Any help would be appreciated.

If you have been married and living outside of the UK for more than 4 years you can apply for ILE online from the us. If you pay for an expeditor (about $150) you can get your decision in 24-48 hours.

Thank you for the prompt response - would you know how long a person has to enter the UK if a ILE is approved. We wouldn't want to have, say, 2 months to enter the US as our property is currently rented.

you can enter at any time after approval with ILE

Then I think you would need to apply for a spousal visa with KOL REQUIRED. Or have him take the test on a visit, return back to the US and apply for ILE.

Thank you again, these are the issues that have been confusing me. I've just purchased and downloaded the PDF booklets for the Life in the UK test. We may make a quick trip to the UK then return to the US and apply for ILE.
