Unmarried Partner Visa - Interview

Hi,

My girlfriend & I recently applied for an unmarried partners visa based on my HSMV. The BHC in New Zealand has asked for her to attend an interview to go through our case.

Has anyone had any experience with one of these interviews or have any idea what might be asked?

No need to worry too much here. In the year to 31.03.05 there were 1582 settlement visas issued in Wellington ... and just 3 rejected. With UPV the main issue is likely to be proving the couple have lived together for two years ... and also the usual financial and accommodation issues.

Edit : What exactly is it she is applying for? I see in a different topic that you are not settled in the UK.

JOHN: As above, we are applying for an unmarried partners visa attached to my HSMV? I am currently in the UK coming to the end of my 1st year on HSMV.

Where did you get your stats??

The stats? The global stats issued by IND.

But the figures I gave don't apply to you, or rather, your partner. She is not applying for a settlement visa given that you not settled in the UK.

I agree with Chess, you are playing this dangerously close. Whatever happens do ensure that your visa application is received by IND no later than the expiry date of your current visa.

I think they will consider issuing a visa, providing they are happy with whatever they ask in the interview, purely because they have requested the interview (which they don't have to).

Otherwise, they would have rejected the application already. If not, I would be very upset that she had to pay airfares, accommodation etc (at short notice rates) to find out they may refuse the application based on a fact they have known since the application was submitted. (6 weeks ago incidentally - and yes they are as hard to contact & non-commital in NZ as they are in the UK)

They have put the application on hold until I renew my visa. Would this be grounds for urgent treatment?

Can the Home Office issue a new visa before the old one has expired or would it be issued with a start date from when the old visa expires.

sure; that could qualify for request of urgent treatment. just tick *other* box on the request form.

as i advised you earlier - it would jhave been inappropriate for BHC to issue a visa for 1 month :roll:

so putting it on hold until your visa is renewed seems to me to be a postive sign....

My girlfriend has finally received her visa, after I successfully obtained an extension.

However they backdated her visa by about a month & a half.

Will her ILR clock start from date of issue or when she re-enters the UK?

drewchad, backdated it? It is a two-year unmarried partner visa? And they have put a start date of six weeks before they actually issued it?

I have to say .. are you absolutely sure? Or is there simply confusion over the date format? For example, in the UK for say 10th December we would write 10.12.2005 but in some other parts of the world they would write 12.10.2005. Is it as simple as that?

And the stated expiry date on the visa?

Having not actually seen it I cannot be 100% sure. But I was told:
Start 10/11/05 and valid for 3 years - in line with my HSMV.

Ah right ... she is a dependent upon your visa. That makes sense. The start date really does not matter. The expiry date of her visa will be in line with the expiry date of yours.

ILR? When you apply for that in nearly three years time you will include her as a dependent and thus she will get ILR at the same time as you.
