Question - Uk Citizen married to US citizen in USA

Hi

Thank you in advance for any answers or advice given here, We're really new to all this stuff and don't know where to start. Also, sorry for this being long winded but I want to give as much information as possible to help.

Our situation:

I'm a UK citizen who went to USA 3 years ago on a 3 month visitor visa. Married my wife 2 and 1/2 years ago and stayed in the US. We have a 6 month old son who was born here in the USA. I am currently classed as "In Process" with US immigration as I have not fully paid the fee's, so I have no SS number here and cannot legally work or drive.

We have decided it would be better for us and our son to relocate to the UK and are having a little trouble working out how we should go about doing this.

From what I can find out I could move back on my own and then my wife could apply for a visa for her and our son and away we go. But neither of us wants that option. I would like to be able to move back to the UK with my family at the same time.

From what I can ascertain, we need to apply for a Spouse Visa? (Where can I find the forms for this?) and we need to show we have enough money to support ourselves when we move (How much, and for how long?) Is there any way we can arrive in the UK and then apply for the relavant visas there, or do we have to do everything here first, then move?

Any advice anyone could give would be extremely appreciated!!!

Not easy, you won't be granted a spouse visa for ur missus unless;

1. U have loads of savings

2. U have a job in UK and income

and;

a. U have suitable accomodation arranged.

Proofs are required, not promises I'm afraid.

So, best for u as the Brit to move back to UK, establish urself with job an a place to live and call ur family then.

Form u require is FLR(M) and the fee is £485 in local currency. U will need to show, as above, u have somewhere not overcrowded to live, and u have 156 quid a week disposable income after all bills such as rent/mortgage/utilities etc.

Your wife may apply for a spouse visa, subject to the Maintenance & Accommodation requirements.

Unfortunately, visitors may not switch to FLR(M).

If you are British otherwise than by descent (e.g. born in the UK), then your son is British and may apply either for a British passport or a Certificate of Entitlement to the ROA.
