Dependants - accommodation/overcrowding

Post by hert » Sat Dec 31, 2005 12:36 pm

Hi there,
I am on hsmp visa, working here since last 3 months getting decent salary & can easily show abt 6000 GBP in my a/c. My question is regarding dependants visa for my wife (& 2 yr old son). I have read on this forum regarding accommodation & overcrowding/space requirements. But am not able to understand those ACT terminology. FYI, I have rented a one-bed flat (1 bed room & 1-living room, . each abt 10x11, 1bathroom, Spam), fully-furnished. The tenant agreement doesn't mention the flat details, however, an inventory is provided to me.
Will there be any problem in getting visa for my wife & child, with this kinda accommodation?. They will be going to BHC, Delhi,India.
Thanks in advance for your comments n suggestions.

Hert

If you look at this topic and compare that with your facts, it sounds like you have two "counting rooms" and are therefore allowed to have three people living there.

However you have only 2.5 people to live there, so it certainly does not appear to be overcrowded. 2.5 people? "A child aged 1 - 10 years will count as only half a person."

Dependants - accommodation/overcrowding

Hi John,
Thanks for your quick reply. I understand that 1-bedroom (if shared by husband & wife) is sufficient for 2 persons but was not sure about living room (since my kid is 2 yr old, shd be counted as 0.5 person). Actually I was not very clear if the living room is considered while counting total number of person livings. Well if they are considering 1-bedroom & 1-drawing or living room as two rooms, I guess I should mention in the covering letter, since my tenant agreement doesn't mentions about house details or should i attach an inventory with my application (though it would contain minute details of household items & not area details). What do you suggest. FYI, i'm residing in hertfordshire.
Thanks a lot.

Hert, I think it would be useful if you ask the owner/letting agent the following specific question ... and include the answer with your evidence :-

Ignoring Spam, bathroom or toilet, how many rooms are greater than 50 square feet in size?

Based upon what you write the answer will probably be two ... sufficient for three people .... you and your family are defined for this purpose as 2.5 people ... so no problem!

You mention living room and bedroom. Those terms are not actually part of the test you and your family need to pass. How you use each of the rooms is totally up to you.

Hey John,
You are right about using living room as per my convenience & so there should not be any problem. Well, I do intend to contact my agent/landlord to provide me some document/letter mentioning basic details of the property.

thanks a lot for your advice.
