marriage visa help

Post by kcharlie » Mon Jan 18, 2010 10:26 pm

hello, im hoping to get some advice, im a uk citizen and am marrying my albanian fiance in april this year, after we shall apply for settlement visa for him to join me in the uk.
We met 6 years ago and lived for three years together in the uk we broke up for a couple of years in which time i had a child with someone else. 2 years ago he was deported and we began our relationship again via dailey calls and internet chat and email. i went to visit him last december for three weeks with my son and decided to marry in april.
My question is will the fact that we had broken up before cause our proplem for our application, in other words will they see our relationship as unstable?
also i have proof of us living together previously, plus email, phone bills, photos plane tickets and all the other things requested bank statements payslips offer of employment for my fiance in the uk etc.
Another question is, im currently recieving some benefits here in the uk but i have £5,000 in savings and my job are happy for me to work there full time and have written this in a letter for me, also i will be sending in his job offer letter to prove we can support ourselfs straight away without public funds, but will this be enough?
Thanks for any advice

I'm assuming you're applying for a spousal visa?

The things you listed seem to cover all your bases. I really don't think your seperation will cause your visa to be refused. It doesn't matter if in their oppinion your relationship is unstable. They can only grant or refuse the visa based on the evidene you provide. You have proof of a genuine relationship and fullfill the rest of the criteria so it should be granted.

However, I just noticed that you didn't put anything about your accommodation. Do you have suitable accommodation where over crowding will not be an issue? And sufficient proof of this?
I tell it like it is.

thanks for your reply, yes we are applying for spousal visa.
I live in a private rented 2 double bedroom duplex. ive been living here for a year and a half and have 2 contacts to send. Some people have said to me that you have to provide letter from landlord with her agreeing that my partner can live here? is this true or is the contract enough.
Will i need to take pictures and draw up floor plans of my residence or will the fact that it states on the contract its a two bedroom place be enough?

If the contract does not have your spouses name on it then yes you would need a letter stating that your spouse can live in the house with you.

It's best if you take pictures and write the measurements of each room on the back of the photos.

Why was he deported? Did he use a false passport or papers or otherwise use deception?

Ah, I didn't spot that.

If he got deported for decieving, he may be refused a spousal visa.

hi, yes he was deported for being here illagally and having fake documents. He had a fake italian id card. we know their is a ten year ban for people who have been deported however we know this ban can be waivered for those applying for married spouse visa. A friend of ours recently got married and had his visa refused for using deception in the uk with kosavan passport but was later accepted when he appealed the case.

Good luck then, but I fear you have a battle on your hands.
