Marriage visa

I just recieved my ilr which i applied for last year september.I got married early 2009 in my country and while i was waiting for my ilr to go through,my wife applied for visiting visa as a single -not married and was refused twice. Now that my ilr has come through,will it not be a problem if my wife now apply for a marriage visa since she has applied as a single before when really,she wasn't single?Please help me out what is the best way to deal with this?

She needs to apply for spouse visa not marriage visa as you are already married.

Providing you can show that you can maintain, support and accomadate her, she should have no problem getting visa to join you.

Thank you so much for that information but won't they say why didn't she declare that she was married when she applied for visiting visa in october and december.That is withholding useful information about herself when she knew that she was married.

She thought since my ilr hasn't gone through she couldn't possibly mention my name in her application.What should we do then?

In my experience there are two reasons for this:

1. The applicant/spouse were not aware of which visa to apply

2. They are aware but decide to go for the easy and cheap option which is to get a vistor visa and on arrival in teh UK tries to apply for spouse visa from here in the UK, however be unknown to them, they are not allow to do this as this is called "jumping the queue".

I am not saying OP has done this, but he now has a damn hard job trying to explain why his spouse made 2 such applications and falsely declared certain things.

Reasons for refusal was that they are not convinced the senior sister she was traveling with on holiday was actually her sister.

I think you need to clearly explain everything fully and not in drib and drabs as to your full cicumstances, otherwise you are going to get confusing advice

I have explained in my first question.The issue is my ilr wasn't decided,she applied for visiting visa to also enable her see me since i couldn't come because of my passport in home office.She planned coming to the uk with her elder sister on holiday while waiting for my ilr to be decided but she was refused reasons being that they are not convinced she is her sister.Her sister uses her husband's surename which was different from my wife's family name.But when she was refused the first time,she sent in documents to proof the relationship to her sister but they still wasn't convinced they refused her again and then i told her to forget about it and just wait for mine.

My wife should have made it clear in the form that she was married but she didn't but rather filled in single.

Now she wants to apply for spouse visa and my question is will this constitute a problem since she filled in single before instead of married.

It most certainly will, as the marriage certificate is obviously dated before she even applied for the visitor visa!
She really has to come up with a very good reason as to why she said she was single in her previous applications, when she very obviously was not!
Deception, intended or not, springs to mind!
Maybe you should get a solicitor to help with this application.

I would make it a "super magician", as I see major problems with this now.

Boy I hate it when people are not clear and honest in their post when they post first time.
