can i visit my husband??

Post by savill111 » Mon Jan 25, 2010 4:31 pm

(kat wrote)Hi, im new on this forum but hopefully im writing under right topic.

I am russian citizen but I lived in Finland for almost 9 years and i have permanent residence here.

I am married to UK citizen, we ment 2,5 years ago and got married last July. Before that we had to battle our way to get a marriage visa for me for almost a year.

I had to come back to Finland at the end of october because I was not allowed to apply for settlement visa, because we were not both 21.
We decided to get me another 6 month tourist visa and then apply for settlement.
At the moment im stuck in Finland already for 4 months with 3 visas refused, with one same reason- ECO doesnt believe that I will leave UK at the end of my stay, just today i got my 3d refusal and it was a Family visit visa. As my proof I gave them letter from my mum and supporting documents from her to show my family ties in Finland, also me and my mother own a flat in russia, which document I also gave to ECO. I have ties to both countries, tho i dont have work or study place which ECO keeps pointing out. But I was in UK for 6 months and my marriage visa got accepted with all same documents.
During my last visa application my husband got a call from embassy, but he wasnt able to answer his phone at that time, when he tryed to call back they didnt want to contact him with anyone, then hey told him that they will call me, i wasnt near my phone when they called so i phoned them back. Basically woman on phone didnt want to talk with me and said to wait till embassy calls me again, they never did. I tryed to reach them again but same woman told me that if their problem would be so important they would really try to contact me.... 4 days later i get passport with visa refusal.

We both want to live together in the UK, we want to apply for settlement visa for me, but we are so shocked with the way we been treated that we feel really lost at the moment.
Biggest problem is that my husband is unemployed, but he is a jobseeker and his parents are willing to sponsor us untill he gets work etc.
But we dont knw what exactly we need to prove to ECO so i can finally join him in UK, because I think him not having a job is big issue and we wouldnt want to spend few months waiting just to get refusal again.
So my main question is there actually a chance of getting a settlement visa or residence if my husband is unemployed?
If someone can advice us we would be so gratefull, we desperatly need help and we cant find it anywhere.(kat wrote)

(i wrote)Just to clear things up abit. i'm kats husband.
Basically, we intended to apply for temporary visa's until we could then apply for a permanent visa when i turned 21.

with our visa attempts they had not gone to plan and do not fully understand reasons given to us. we provided 40+ documents and still our visa got declined, we provided all evidence available to us but still we did not get the result we expected. we provided flat documents where she was staying in Finland, family passports, proof of ID, flat she owns in Russia.

The reason given was that they do not believe she will return to Finland once in the UK. Although she had a previous visa that was accepted on the same evidence and returned fully complying to all terms of the visa.
Also during the visa process i received a voicemail on my phone on the friday asking to speak with me. I was unable to answer as i did not have the phone on me at that time. So i called on the monday, spoke to the person asking for me but for a strange reason he says he wanted to speak to my wife. Which does not explain why he called my phone instead of my wifes and left a voicemail asking for me.

We got the response today it turned out her visa was declined again but looking at the date it was declined on the monday i had called the embassy. I am starting to believe that the embassy had declined the visa before they spoke to me as they did not mention why they was calling etc.
We just feel abit unfairly treated as all we are wanting to do is live our lives normally but are unable to do this in this situation and we think that the embassy may have broken our rights in doing this. As our only situation change from her past visa that was approved is that we are now married.

Now we must decide what we do next as we cannot provide any more evidence providing she will return to Finland on a temporary visa. So we are wanting to find out if it we qualify for a settlement visa.
Hopefully someone can offer some advice.(i wrote)

hello

From what I know Findand is in the EU, so she can try to apply for the citizenship there and get in the uk without troubles

On another hand, you said that this situation has lasted for over a year. he could have found a job since then , he is really young , so strong , and full of ambitions . He can do something to just show that he has some incomes to prove that he could support her.

Good luck

Oh, you haven't mentioned that before... What exactly where you doing in these 16 months? Currently the UK requires their own nationals to have exercised their treaty rights as worker or self-employed persons for at least six months. Possible also that UK would require a return immediately afterwards. I am not sure about this.
