Student to student dependent

Student to student dependent

If a person is living in UK as an international student, he went back home and got married, few months later his wife joined him as her own independent status as an international student as well. Now he wants to change his status from student to student dependent, what will be the procedure? Does he need to leave the country or he can submit in-country application? He got almost 1 year left in his visa and his wife got almost 2 years.

You can do either way. But HO still suggests to switch it from Home Country.

Well, as a matter of fact that sounds very rude to me. I lived in this country for 5 year, done two degrees always play by the rules. Now they asking me to leave the country spend extra money on flights and apply dependent visa from my own country and leave my wife all alone here for that whole period. Although I don’t see any harm for in-country application, but strange government and weird policies, just increasing the hassles of those who playing by the rule. Thanks anyway.

You can always ring and ask HO for further advice. No harm.

I knew a guy from Namibia who actually did it in UK. He was on a student visa and his wife dependent. When the visa was about to finish, they applied for his wife as student and himself as dependent ( so he could work full time ) and they both got it.

However it was at least 3 years ago. Not sure if you can still do it under this new Tier system.

Well HO gives permission to exceptional case.

The case mentioned above was successful, because, main application wife applied for visa, and husband applied as a dependent at the same time. So Main application was for main student and dependent just joined it.

But in your case, your wife visa is expiring three year later and yours in 1-2 years. Therefore your wife cannot apply for extension / new visa till than, which means you have to apply for dependent visa only earlier than her.

Now in your case, you should try to apply from here, asking HO that your case is exceptional, and by leaving the county, you have to pay for ticket, leaving your wife alone (cultural values of your country may benefit here) and living alone for 2-3 months when your visa will be processed.

Yes HO may understand those reasons and may grant you the visa in this county.

Also please feel free to consult a good solicitor to have their opinion too.

Wish you best of luck, though it is far away and who knows, that by then rules may be different.
