EC for dependants - Help needed

Hi all,

I am in the UK on HSMP since December 2005. Recently found a job in Reading with one of the Big4 audit firms and going to join from Jan 23rd and hence applied for EC for my wife and 9 month old son. But it was refused in just 2 days. They have given three reasons for refusal but i can arrange mitigating evidences for all those. What i need to ask now is that would it be quicker and better to go for a fresh EC application or should i go for appeal??? Also, is there any time restriction on re-applying (fresh EC application), i mean i heard from some one that once an EC application is refused you can re-apply only after 6 months have lapsed from your last EC application.

Grounds for refusal for my family's visa application are:
1. "Its only an offer of employment and no evidence that the employment was taken up"
I intend to get a joining/employment confirmation letter from my employer stating my employment number and temporary NIC no. after joining on 23rd. By the way the appeal deadline is 5th of February.
2. "Only mentioned funds in your bank account and did not mention funds available to your husband in the UK"
I will scan and mail photocopies of travellers cheques so that they can be attached with the appeal/reapplication. Besides, this might not be an issue once i start my job. right??
3. "Evidence of accomodation is only an e-mail from husband's cousin"
I think i can add courrier envelopes addressed to me by my employer. Also a copy of reference letter from my employer to Natwest Bank confirming my contact details. I have applied for a current account with that bank but i think it will take a couple of weeks before it is opened.

Ok now, i will appreciate if you guys can address my queries and also see if the evidences i listed above are sufficient enough.

nomanlodhi, obviously you want to get your family to the UK as soon as possible but if I were you I would do the following.

That is, after you have actually started the job, you should get your wife to submit a fresh application for her and your son. But this time she should ensure that the supporting evidence will show that the tests will be passed.

For example, it needs to be proved that the your family will not need to claim certain Public Funds. Now, there is not just your capital sum available but also your monthly salary to prove that no such claims will be needed.

Also, accommodation! I think you need to do a lot better than previously, ensuring for example that it is clear that your cousin's place will not be overcrowded when all of you are living there.

Yes you could appeal the previous rejection but submitting a new one will probably be a lot quicker.

your application is a bit premature. "Settle" down first and then apply for depedants.

Thanks for your replies.

I am going to stay with my relatives for cosiderable time period. And there should not be a crowding problem John. It's a 5 room house occupied by 2 persons (excluding myself or my family).

I intend to gather all the evidences that i can for income, accomodation and also get a letter from my employer plus details of my UK bank account (that i am going to apply tomorrow through my employer). John! are you suggesting that we can re-apply with a fresh application without going for an appeal first or waiting for certain time period to lapse??? Because my understanding is that one can not re-apply within 6 months of a refusal.

No, not at all.

I think your choices are ... appeal, and submit further and better information ... or submit fresh application. Given the length of time appeals tend to take it will probably be quicker to re-apply.

Accommodation detail sounds promising .... don't hold back on the detail. Ensure that any fresh application, or indeed an appeal, is supported with much better quality of supporting evidence than previously.

Chess says .... ""Settle" down first and then apply for dependants. " ..... I am not saying he is wrong but certainly ensure you have started your job ... indeed seeing the first salary payment arriving in the bank account would be good!
