no tax withdrawn -- is that a problem?

no tax withdrawn -- is that a problem?

Hi,

I'm an employee and director of my own limited company. I'm concerned that tax and NI has not been withdrawn from my company's earnings. Will this create a problem with the Home Office?

To summarise, I've been the director and sole employee of my own limited company since April 2009. From then until the end of 2009, my company had £30,000 income. Of that total, I was paid approximately £2,500 in PAYE income and £25,000 in dividends. The other £2,500 was paid to my accountant.

If I claim £27,500 income -- from PAYE and dividends -- will the Home Office accept this as applicable towards my Tier 1 visa? I have bank accounts to prove that the funds were transferred to my account.

1. Ask u accountant that why we the company did not pay the Corporation Tax for the company's profit.
2. Unless u company was below the limit of the tax amount.
3. Did u pay TAX and NI for u salary from the company?

Also ask the Accountant why he grossly overcharged your company.

I appreciate your speedy reply.

1 & 2. I'll confirm this with my accountant tomorrow but he has spoken before of a 32,000 threshold, which my company is still below.
3. I haven't yet paid tax and NI for my salary, although I will at the end of the tax year. (In my defence, I'm not a freeloader -- I pay NI and tax through a part-time PAYE job.)

One reason I asked the question in the first place is that on p. 26 of the tier 1 guidance, paragraph VII addresses a 'payment summary' that is created by an applicant's accountant. The guidance says that the summary should include a breakdown of the gross salary, tax deductions and dividend payments made to me. Now, my accountant provided a statement for me but did not address tax deductions, I assume because none have been made.

My question is, is it fine for me to submit my payment summary as-is, or should I ask my accountant to re-draft it with a reference to the lack of tax deductions?

I agree, too. I've just realised this over the past couple of weeks. Ugh. If you have any suggestions for good accountants, I'd welcome them.
