Buddy.. you are about to apply for Tier1 and you are already asking questions about your landing and staying in UK.. think step by step and take it as you move forward..gonche wrote:Hello All,
I am about to just submit my application for the PBS-Tier1 (General) to the British Embassy here in Amsterdam. I really had some questions, I hope some of you might help me answer the questions.
1. I have all the bank statements for the whole year and the employer's annual income statement (which a single page). This annual income statement has only a few rows which state my gross income for 2009, the tax I paid and the tax my employer paid. So, my question, is this enough (instead of pay slips)? Please note that the salary amounts credited to my bank account is a net amount and there is no way they can corroborate my income from the two documents (in the annual-income-statement, it's only gross + taxes, in the bank statements it's net, and when I was adding the total amount I got, it doesn't match Gross-minus-tax. I couldn't understand the statement as it has rows with gross, tax paid, tax credit, taxable income and tax-paid-by-employer).
2. If I eventually get the visa, what's are the landing procedures? Do I have to show any of the supporting documents when I land? Do I have to provide an address and will they ask me if I will stay in the UK afterwards? My plan is to go there for just a week and come back to the Netherlands and move again after 8 or 9 months. I am applying now, as I want to get points for age.
3. How long do I have to stay inside UK after the first landing with the visa? Is there any document or ID I will have to wait and get before I leave?
4. Can I enter, leave and stay outside UK for as long as I want as long as my Tier1 visa is valid? Doing so, does it have any consequences (especially for extension or ILR applications)?
5. Will I be eligible for health insurance with a Tier1 visa?
6. Can I study at a University (for a 2nd masters) with a Tier1 visa? If so, what fees am I supposed to pay -- international or local?
Please, answer me as much as you can. Any help is appreciated and thank you very much.
Will not be accepted as valid evidence unless gross and net salary are clearly mentioned in the income statement from the employer. Read para 138(iii) of the Tier 1 (General) policy guidance.gonche wrote:for the Tier1 visa application, i will just send all the payslips i have, along with the annual income statement.
You can travel and return anytime you wish, but any long absences can be questioned by the Immigration Officer. The vignette in your passport is all you get.gonche wrote:3. For extension you need to fulfil certain criteria (e.g.- income). If you do not intend to reside and work in UK then extension could be problem. Absences from UK have no bearing on Tier 1 extension, all you need is to fulfil the qualifying criteria for extension. But absences affect ILR. As on date, the rules say that to be eligible for ILR one must not spend more than - 90 days at one single time and 180 days in 5 years all together - outside UK to be eligible for ILR. If you do, your ILR clock is reset.gonche wrote:4. Can I enter, leave and stay outside UK for as long as I want as long as my Tier1 visa is valid? You will be entitled to NHS services in UK.gonche wrote:5. Will I be eligible for health insurance with a Tier1 visa?
You can. But again, your extension will depend on you qualifying for it and earning money is an important parameter in extension assessment. Until you have ILR you'll have to pay international fee.gonche wrote:6. Can I study at a University (for a 2nd masters) with a Tier1 visa? Why do u want to take risk knowingly.. HO can not accept/check ur income based on Annual Income vs Bankstatements.. If you think u have excess money to waste on fee.. better donate it..gonche wrote:thank you sushmehta and tvn_ramesh, for your responses.
yes, you guys are right. i shouldn't expect a visa officer to understand a document that i myself did not. but then still, i still don't understand my annual income statement. i am not from finance and all the terms are financial jargons. the thing is, i lost one of my pay slips and i did not want to go asking around for the Human Resources (HR) to issue me a replacement. in my organisation, all the HR works are outsourced and i wouldn't even know who to contact. in any case, for the Tier1 visa application, i will just send all the payslips i have, along with the annual income statement.
collect all ur bankstatements and put them in order in 1envelope.. make ur case as easier and simple for the caseworker..i just have one more question: should i send the bank statements and the payslips with their corresponding envelopes? the bank statements are A5-size papers and some of them are 5 or 6 pages for some months. so, i was wondering if i could just send the statements in their respective envelopes.
Sushdmetha answered for u abovewould you also plz answer me, in short, the remaining questions? i am sure you know them well, as you guys are seniors in here. i know they sound silly, but i would be glad to know. or, u might just want to give me a link where they are discussed. i have been browsing around here in the forum, but i couldn't find answers to those particular questions.
thanks a lot!
The link provided has all the information of who pays home and who pays international fee.6. Can I study at a University (for a 2nd masters) with a Tier1 visa? If so, what fees am I supposed to pay -- international or local?
Sorry, I thought the annual income statement you were refering to was like a letter from the employer detailing your salary. But now that you say it is something similar to P60, then we can term it as a "tax document" issued by the employer. A tax document is a valid evidence only when the assessment period of the tax document (e.g.- for P60 it is Apr-Mar) is exactly the same for which you are claiming points for (ie.- if one is submitting P60 as one of the evidence, then the 12 month period for which can claim earning points can only be Apr-Mar)!gonche wrote:as for submission of an annual income statement, i thought that was acceptable. That's what the documents' requirements, for previous-earning, clearly states. The statement (equivalent to the UK's P60) does not normally tabulate monthly gross and net payments, it instead describes the total (net and gross) payments made for a specific year. So, i thought this could be submitted as an evidence for earning in addition to the bank statements.
Not sure if this is a local practice but this is the first time I have heard of such a practice - not issuing payslip unless net salary changes!gonche wrote:My employer issues a payslip if there is only a change in the net pay; i.e., if the net payment for a current month is exactly the same as the previous one, then no payslip is issued for the current month. i hope this is a standard procedure and the case officer will understand it.
Are you claiming points for income earned in 8 months - for which you have the payslips? Or are you claiming points for income in 12 months but providing only 8 payslips (out of 12)? If the former, then fine! If the latter, then the caseworker will not award you points. And also, if such is the case then I would strongly recommend that you read the Tier 1 (General) policy guidance *carefully* a couple of times at least!gonche wrote:So, 8 payslips have been issued for the year and i have 7 payslips ready. i lost one of them. i contacted the human resources and they emailed me an electronic (which obviously is scanned) copy. i will just have it stamped and i hope seven-original and one-verified payslips should do.
Sorry but it doesn't work that way. Do you mean to say that if my net salary remains the same for the 13 months in a row, my application should be approved on the basis of the 1 evidence only (since net salary didn't change for 13 months I never received a payslip and therefore cannot submit any, please understand)!gonche wrote:no i am claiming points for a 12-month earning, with 8 payslips. like i said before, my employer issued me only 8 payslips over the entire year. for those months of which my net salaries were exactly the same as the preceding months, i was not issued a payslip. this is the policy in my company. i am hoping, with a cover letter attached, provided the case worker corroborates the net salaries in the bank statements, he can see that if successive net salaries are exactly the same, he shouldn't expect a payslip.
As long as the assessment year in the annual income statement (e.g. - Jan to Dec, Apr to March etc.) and the 12 months that you are claiming points for *are exactly the same* you can use the annual income statement as one of the evidences. Otherwise not!gonche wrote:now that u understood my annual income statement (tax report), which doesn't have details of gross and net payments in each month, do you think that's enough for evidence? my concern is, when i added the net payments i was paid and checked it with the one stated on the tax report, they don't match. i was paid 82euros more than it was reported on the tax report. as you already know, in the tax report, it's only stated the annual gross and net payments made, and i was wondering how a case worker would verify the net salary credited to my account.
regardsTier 1 (General) Policy Guidance wrote:Please note that because tax documents are usually produced at the end of a fixed tax period they will not necessarily show the entire period for which the applicant is claiming previous earnings unless they are for the exact period claimed.
For Employer Letter, you do not need to talk to your Human resources ppl. once you prepare the letter and the salary table format as per chetan sticky.. Even your Reporting Manager can sign and give his contact details.. in the same letter you can include the 82euro's and explain it in brief.. i think this is the best way for you..gonche wrote:thanks tvn_ramesh.
the human resources is outsourced in my company and i don't even know who to contact. i asked the manager, but he said he had no idea.
ohh yea i do get a statement every month from my main account (like u said, at least there is salary credit every month). but for my savings account, which is in the same bank but a different account number, if i don't deposit/withdraw, no activity and thus no statement. but the statements have serial numbers and it's very easy to know their sequence (regardless of the month of issue).
my concern is, there is an 82euro difference in the net-salary my tax paper says i was paid and in the sum of the net salaries credited to my account. this 82euro is a one-time allowance in a year and is tax-free. but it's not included in the net amount on the annual tax paper.
