Hi everyone,

Wondered if I could have some (more!) advice ..... as per my older posts, you may recall I am married to a Kurdish asylum seeker.

My husband and I have been married for nearly two years (on 1st May 2006 - islamically, 24th July 2004 at registry office) and we have a one year old son. I wanted to ask your guidence on the HM internal guidelines DP3/96. My husband has no decision on any of our applications; asylum, marriage or human rights, as yet. I have picked up from various sources that if we manage to get to two years (4 more months) without a refusal on his asylum application, then things might be a bit easier as the applications can be looked at differently - "outside of the rules," or something similar. Would this apply from our islamic marriage or civil marriage? Can anyone shed anymore light on this? To what extent would this apply in our case (quite realistically I would have thought, as one would hope that the HO would deem Iraq to be unsafe for me to return with him to, but stranger things have happened!) My husband is not from one of the three Northern regions of Kurdistan that are deemed to be slightly safer by the UNCHR. Also, how much impact would DP3/96 have on our case - would it significantly improve our chances of success, or just slightly?

Sorry to bombard you :-) Our lawyer no longer works for the practice and they firm are waiting to recruit his successor. I work full time, own a property of a suitable size, and I'm also studying at Post Grad level which ties me to the UK for another year. My husband also now works full time (he got permission to work as he was waiting over a year with no decision) and has only ever claimed NASS support for three months - but such things are irrelevant to the HO in all realism, I know.

So, basically, can DP3/96 help us?

I have a copy of DP3/96 which i got from the homeoffice under the freedom of information act, if you send me your email in a personal message i can send you a copy. But beware i have been waiting a year and five months for a decision and i am now in the process of withdrawing my application and going to my home country and apply.
