Language school wants student to start before visa granted

My girlfriend current has a Prospective Student Visa and has applied for a Tier 4 visa and is awaiting an answer.

Her course was scheduled to start last Monday and the language school claim that even though her visa hasn't been granted yet, she can begin to study on the basis that she has applied for the visa.

Does anybody know whether this is legal?
