Does the ILR & Spouse Visa have to be with the same Brit

Post by marriedlady » Tue Feb 23, 2010 7:43 pm

My husband and I were married about 6 months ago.

Prior to meeting him he got his ILR via his ex partner. They have obviously since split up.

His ILR was granted 2&1/2 yrs ago on the grounds of being the partner of his ex (a brit).

Now we want to apply for him to be natuarlised & become a Brit citizen as my husband (I am a Brit).

BTW - he has been in the Uk on Work Permits, ILRs etc for nearly 10 years.

So what we are confused about, is if there is going to be an issue/rejection on the grounds of the fact that his ILR was granted on the basis of being the partnert of a different person to whom he is now applying for British Citizenship/Naturalisation.

Help.

That does not matter at all. The question is simply, is the person married to (or in Civil Partnership with) a British Citizen, and if the answer to that is yes, a Naturalisation under the 3-year rule can be made.
