Dependant+WP+HSMP+Tier 1

Hi all,

I am here in the UK since June 2004 but not sure about the timings when i can apply for ILR. Here is the brief summary of the dates etc

June 2004 - Moved to the UK on dependant visa
February 2006 - Moved back home just before the expiry of the dependant visa
February 2006 - WP approved
April 2006 - Got the visa stamped and came back to the UK on WP
February 2007 - Got HSMP approval
April 2009 - Got Tier 1 approval for 3 years

1. Can the period spent as depedant be included while calculating the 5 years for ILR? Although I had my WP letter but there was no visa on my passport for a short period between February and April 2006. Would that have any impact on the inclusion of the dependant visa period for the purpose of 5 years calculation.

2. If I cant include the depdendant visa period, when would the calculation for 5 years will start?

3. Finally, i have heard that HO is going to change the ILR rules. When is that change going to happen and would that have any impact on my elligibility to apply after 5 years.

1. No. It cannot be included as you are applying in a new category on your own.
2. ILR clock will start from Apr 2006 when you came to UK with WP.
(The date of landing in UK is important not the date when your visa was stamped).
3. ILR rules will change in July 2011.
