please share your experiences of applications made after visa expiry and had a success

In general, applications for leave to remain submitted after current leave to enter / remain has expired are not considered valid applications and are, usually returned, wihout any assessment or action.


Unless you can present valid reason(s) as to why you could not submit an in-time application and that such reasons(s) are acceptable to UKBA or unless UKBA has confirmed to you that they will accept an out-of-time application from you, IMHO, the chances of your application being accepted as a valid application (even) are remote ..... and, on top of that, having hopes of a decision (and that too a positive one) are perhaps asking for too much.

If you can share why your application was submitted out-of-time, people might be able to answer your question(s) more precisely.

The link ramesh copied is my case, i have posted my application before my visa got expired(26 jan Application date,Visa expiry- 01 Feb), but the application was returned (13 Feb) because the paymnet process was not succesfully as a wrong number was used in the process, i do not know whose mistake was it, UKBA did not return the payment details sheet to me, as per i know i have entered correct details.

I have called the UKBA and explained my case and they adviced i should resubmit ASAP, i have resent my applciation with a coverletter on 16 Feb.

The applciation which came back to me had a lable with barcode and the application received date, i have enquired few of my friends and they adviced to post it back with out any changes to the application.

I do not know exactly if the UKBA will consider my application as one which was previously posted before the VISA got expired or a newly received

I have not enclosed the latest bank statement (covering the dates between the 1st applciation to the 2 application date) showing the maintenance funds availability, i have sent it today by a covering letter to the address on the application form

I have absolutely no clue how this is going to be, so browsing this forum to find if anyone else has gone through the same situation as mine and looking for advcies

Hi,

Just to update my status, I got my Tier 1, 3 year visa extension today :D

26 January 2010: First application made
01 February 2010: Visa Expired
13 February 2010: Application returned back saying invalid application for unsuccessfull payment
16 February 2010: Re sent the same applciation form with entering payment details again
18 February 2010: Payment successfull
26 February 2010: Realised, I did not sent the last 1 month maintenance funds proof (bank statement)
01 March 2010: Contacted the home office and this forum
02 March 2010:Posted the Bank statements with a covering letter
02 March 2010 to 22 March 2010.: Sleep less nights, days with worries, stress and tense

Lesson learnt: Post the application as early as you can, double check and triple check the whole application to make sure the application is made as per the UKBA requirements. 8)

any info on working while waiting for second applictaion

I am in the exact same situation, wondered if anyone knows the rules with regards to working while the second application is pending a decision. As far as I can tell section 3C DOESNT apply as the application is "invalid" (the application is definately "invalid")however section 3C also says that it DOES apply if a case is neither decided nor withdrawn (the application hasnt been decided or withdrawn)....it is very ambiguous.

I dont want to stop work for +-6 weeks while they consider my new application.

Any help would be appreciated, this is too stressful.
