ILE 4+ period explanation please....

Post by itworker001 » Tue Mar 16, 2010 11:03 am

Friends,

My question is about the qualifying 4+ year’s marriage period for ILE with or without KOL. I have been married for 5+ years and we are outside UK (in Brussels) for this time; however I have visited London for official meetings (day trip by Euro Star). My wife is planning to visit UK on an EEA permit (because it is free), just for the sake of appearing for the KOL test. Once she has passed the test and we are ready to apply for ILE, will she be deemed that she is no more out side UK for 4+ years as she would have travelled to UK to appear for the KOL test?

In my opinion as long as the marriage has been subsisting for more than 4 years; few visits to the UK should be OK, even if these are on EEA permit which leads to settlement.

Am I wrong in this assumption? Can any of the moderators please qualify this? Vinny/ElenaW any one please......

I have asked this question on my previous thread but then the main question got lost; so I have opened another thread; sorry if it violates the rules. I am just trying to find an answer for this 4+ year period.

Regards.

The rule is that you live outside of the uk for four+ years. You have done that. Visits and holidays don't count. You should be fine.
I tell it like it is.
