Not getting Letter from employer

Not getting Letter from employer

I am planning to apply for tier 1 and in the previous earning section i need two proof of earnings... One is bank statement + Salary slip / letter from employer.
My earnings are in two places:
While i am earning my full salary in India while on assigment in UK.
Other part is my UK earnings in the form of allowances (cash credited to UK bank).

I have got my indian salary slip attested along with the bank statement from my employer but they are refusing to attest the UK sal slips saying some policies etc...

My calculation is that i am earning enough points if i am showing my Indian and UK earnings combined but not with the indian earning only.

WHile all my UK allowance are paid to the bank in GBP and i have the salary slip refelecting the same amount but company not attesting.

Please suggest wat are the options i have now.
This is beyond conclusion now that employer will sign the sal slips for uk earnings.

One option is that i send the unattested UK sal slips with original bank statement for UK income in GBP (along with Indian bank statement + attested indian salary).
But i doubt HO will not consider the sal slips without attesttation.

Please advise my options.

Option 1. Are your UK Payslips ORIGINAL? If yes, in that case you dont require sign/stamp on them;

Option 2. Can you contact your UK employees on email and request them to give you a employer letter with monthly salary details as per chetan's sticky above.. this letter can be given by HR or your Manager in UK

Option 3. Can you send your UK Payslips by registered post to any of your well know Managers who can help and ask him to attest/stamp them and send back to you?

May be they have the idea why i need that. They have easily attested my Indian Salary slips.

Believe me it is now or never for me.. from April 6 with new rules i cant qualify in previous earning.

What are the options i have.

What kind of HR you have? Its your legal right to get it attested since you are paid for it. Sue them if they dont.

As far as I know if you have original payslips or if they are on employers letter head (not e-payslips that you have printed) then you don't really need to get them attested.

OR

you can get a letter from employer saying that the payslips you have provided are correct and genuine copies.

OR

you can get a letter from employers them explaining that your pay for that period was £xxxx and you paid £xx Tax and NI and list all your pay for every month (or week, whatever applies in your case) including deductions

Employer has confirmed that they will not be attesting my payslips and wont give in letter head. Even though the salary figures are correct and employer knows this.
Coming to the point:
1. Can i send my UK payslips unattested to Caseworker and mention that employer is not attestsing but if required these figures are genuine and can be validated. Bank statement is showing these figures.

How realistic is that option and will the case worker honestly understand my position and consider that or it will be a flat NO and hence dont submit the application as the fees is 865 pound i guess.

Home office website itsel says that if for some reason you cant produce original then explain your case rather than sending wrong documents.
How sincere is this.

What is the probability the case worker consider that.

Sending unattested payslips is taking risk on your part. You may lose money and valuable time. You need not to have to take sign from HR, it could be someone from Admin Viz. Finance, Admin Officer etc. They generally are bit better than HR and co-operative in these matters.

I would think along these lines "if I were a case officer. If I approve case for a single person without attested payslips (of course with a genuine reason), I might be looking at lot of similar applications in future and this will make my work tighter as I have to scrutinize the applications and reasoning more closely. Should I take the risk of approving?"

The mails from employer containg soft copy of salary slips ... but not sure if case worker will give it a look at all.

I am sure many of the people around have got such a issue.

in a month you should have your P60, which should be good enough. Assuming you are applying after 6-April.

This is the problem.
If i don't apply before April 6, i can't make it based on the higher sal band.

I would like to be sure b4 applying.

I am more interested in knowing what is the most likely outcome if i explain to case worker i cant get my sal slips attested.

what kind of payslips do you have?
e-payslips printed on a simple A4 paper?

E-payslips which can be printed on paper with the company logo on it.
These can be printed on simple A4 prinout and even if i take a colour print the logo will appear in colour.

Any further info needed?

Cannot you request your manager to attest on behalf of HR (with complete details for verification)?

Usually people managers of Indian companies have access to company letter head.

so basically that A4 paper is a company letterhead?

Read the following guidance from UKBA on payslips
Payslips: These should be either formal payslips or on company headed paper. Where formal payslips are produced on plain paper they must be stamped and signed by the employer. Payslips which are not on headed paper or the applicant receives all pay slips online, he/she must authenticate the evidence by asking the employer to sign and stamp a printout.

A4 is not company letterhead.
As the payslips are generated by software, these comes with the company logo on top.

As far as line manager is concerned, they wont attest it (not for HSMP) also the first thing they will ask is get it done from HR and if i say HR is not doing that citing company policies then Line manager will never do that.

Back to Square One.

OR they wont give you a letter with breakdown of salaries you received during the period claimed?

I clearly don't understand what problem the company has got for not issuing you a letter or attested salary slips. My understanding is that every company is lawfully bound to provide the above, provided the employee gives an appropriate reason.
In my situation, I used to work for an Indian company (starting with I and ending with S :wink: ) and I clearly informed them that I was plannig to apply for HSMP and I needed the documents. They haven't even bothered to inform my manager or anyone for that matter.
I would say, just go for it and inform them the real reason. If you belong to the same company where I used to work, feel free to send me a message :wink:

If i say that this is for tier 1, then they will never give for some excuse.
I guess they won't give.

I have no time getting into legal option as i have to apply b4 april 6.

Could any senior member based on the experience can suggest what will be the outcome if i mention to case worker that i cant get these payslips attested

Is this a chance worth taking with my application considering high fees but last chance for me.

They are quite strict about these rules and the chances are more that you will get a negative result. Sorry to say this but that is the truth.

Sorry mate, but I don't quite understand that. Infact, sorry to say this, your company sounds suspicious to me. Why else would they find an excuse to issue you a letter? You have every right to ask for a letter and they have no excuse but to issue you with it provided you give them the right reason. :)
And don't expect the Home office to accept unattested salaryslips. It will be a clear reject.
