Overstay in another country

Hi All,

A friend of mine is planning to apply for Tier 1 G after 06 April, He does qualify for the points but have one interesting twist, His partner and child have overstayed in a country (other than UK on visit visa due to child sickness for 1 month).

Can someone from the board share if this overstay will impact his Tier 1 G application if he declare it? I can't see in VAF 9 asking for such information but they do ask for Overstay in UK.

or does anyone here been in the above condition and have got Tier 1 & can share their experiance?

Its on the record..... even if the country they overstyed in, hasnt taken any action. Why would they, cuz your friend left voluntarily. Still, it is an immigration offence....

My advice is you have no choice but to declare it in your application. Otherwise... u risk getting rejected on the basis of hiding info, even deception in current app, and then have to go through appeal process. If its EU country then its highly likely it will turn up at caseworker's computer...

It should not effect your application but try to get evidence why you overstayed e.g doctor's advice that she should not travel due to child's condition etc..

If i were in your shoes, i would definitely mention this offence and leave it upto caseworker to decide whether i should be punished or not.. because this will turn up anyway.. so why not mention it in first place.

I was on visit visa with my family in one of the Middle East country and overstayed 4 times and every time while returning back I paid the fine as this was the only thing they were looking for. You pay the fine and you are fine. I haven't mentioned it in my application any where. And it doesn't affect my application. I got my visa.
But it is always better to be on a safer side. I havent mentioned because I never thought it as a crime in the first place as they were charging for overstay. But be cautious. Thanks.

But, there is no question in VAF or the in-country application for the dependants asking about overstay in other countries???
