People have been refused because of an invalid passport! Best she apply for a new passport from her embassy asap!gilbutre wrote:Hi everyone,
I'm a EEA and my non-EEA wife applied for a Resident Card. The application was unsuccessful and we plan to make appeal, but her Passport is not valid any more.
Our advisor told us it doesn't matter, but a friend of mine said that without it our appeal or any fresh application cannot succeed.
Could someone tell me who's right ?
Technically it would be ok.If you got visa you can stamped it on new passport easily. For appeal I am sure you have no problem with old passport.gilbutre wrote:Hi everyone,

Yes good point.stmellon wrote:Regardless of legality, I would stronly recommend that your wife obtains a new passport asap from her embassy and the Resident Card is put in that.
If the Resident Card is placed in the old passport, it means having to carry the old and the new passports every time she travels (or paying £165 for a Transfer of Conditions).
