Work Permit (COS) - > Tier 1 ( Entreprenuer)

Hi ..

Got a couple of questions .. I have read the policy guidance but I stil am a bit confused with regards to some issues.

First of all I have a COS from a company in the UK .. I am resigning on the 31st of this month to start up my own company and hence going into Tier 1 (Entreprenuer) ..

Qn 1. If I send in my application before the 31st March [so that my application is done while my leave is still legal in the UK], I wil come under the old rules, right?

Qn 2. I have already completed 2 years on my Certificate of Sponsorship [I assume this is the same as work permit, right?] .. so if I get granted 3 years on Tier 1 - Entreprenuer, will the first 2 years count towards my ILR which I will be applying for after the 3 years?

Qn 3. One of my parents is also assisting with a third party contribution so that I may start up the company, what are the tax / other implications of a direct deposit into my bank account .. I mean how does this whole third party issue work?

Qn 4. How long does the Home Office take to decide on a Tier 1 - Ent category?

I would be grateful if someone would help me out!

Yes, the date of postage (via royal mail) must be BEFORE the expiry date on the visa. If that date happens to be before 6 April, than yes you will need to satisfy current rules as new rules dont appl to you

You will be eligible for ILR if you are on a work permit for 5 years so, i think, you will satisfy that requirement of ILR.

Regarding ur reply to Qn 2, it wouldn't be 5 years of work permit .. technically I have been on a work permit for 2 years now and now I will b shifting to a Tier 1 - Entreprenuer which if granted by the Home office will give me another 3 years. Hence Work Permit (2 years) + Tier 1 - Entreprenuer (3 years) = ILR possible? Would the HO allow a mix of categories like this? Or is it a blanket rule that anyone with 5 years of work, employment and / or business is eligible for ILR?
