hello,

I and my (Tier-4 General Student) wife (Dependent) applied for visa extension 14 days prior to current leave to remain. Got an acknowledgement letter after a week however fees were not taken out from bank account. As a result after 10 days of submission I called UKBA and mention about fees not being taken out from bank. However, I had been asked to wait for 14 weeks. Again, following week, I wrote a letter concerning this issue and again provided the details of debit card (including photocopy card). However, they did not respond to my letter. Yesterday, UKBA returned me all documents with covering letter which states that, application is invalid due to the reasons that bank rejected payment and it could be because details of bank card provided were wrong or account did not have sufficient balance at the time of payment attempt made by UKBA. I am surprised to see the letter as bank details are absolutely correct because before we sent (me and wife check several times) and bank have a good balance and still no penny has been withdrawn. UKBA kept the payment section page of the both of the application form where bank details were provided. UKBA is asking me to submit fresh application. I do not know what to do? Shall I do myself or do it through lawyer? What is my immigration status at the moment? Will they accept my fresh application or they may say, application is made after the expiry of visa. I desperately need help. Please help me.

yes, they will accept your application. however if for some other reason, you are rejected, you will no longer have the right of appeal or admin review because you applied then you did not have a valid leave to remain.

Also, if you have the "10 year long residency" in mind, you should apply quick because the longer you leave it, the harder it becomes!

Thanks for your advice. I submitted correct bank details and I think UKBA is tricking to say that bank rejected payment. In this case, it's UKBA's fault. Do they still penalize to applicant for not giving right to appeal if visa is refused.
