allowed continuous number of days outside UK - ILR

Hi I'll be applying for my ILR (completing 5 years under Tier1 in May 2010) this May. I was outside UK for my daughter's birth (4 months continuous) from Nov 2007 to Feb 2008.

Is there any guidelines which states you can't be outside UK for continuos > 3 months (any link would help) .

If my 4 months outside UK (continuous) is going to create an issue are they going to buy my reason (daugther's birth), if I submit my daughter's birth certificate and letter from employer stating I took off for four months(no pay) for personal reason. My Employer is happy to give this letter.

I am with my current employer since march 2007 till date.

Any other suggestion would help

This will rest with the case worker applying own discretion and compassion. A single break of >3 months is considered a break of continuous residence for ILR, unless it is purely official and you are paying NI and getting salary in UK.
Worth a try. A letter from a doctor suggesting you were required may also be helpful.

Probably you can try with the letter from the doctor that you are required to leave this country for the child birth and also child birth certificate and a detailed letter from your employer confirming that you were on maternity leave and also apply with a proper covering letter. It is worth trying and I know one thing, if you give proper explanation with evidence it will improve the chances of your application approved. It is again upto the case worker.
