Hello,
I am asking on behalf of a friend. She had Tier 1 General Visa, stamped on 9th May 2009 valid for 3 years. She applied under the old rule whereby Bachelor degree was granted 30 points.
I tried to search in the forum, most of people will just said the old rule at the time you submit your application will be the rule that applies.

However, according to the new policy here :

Points awarded for an extension application under Tier 1 (General)
The tables below show the points awarded if you are already in the UK under Tier 1 (General) and you want to extend your stay in this category.

If your current permission to enter or stay was granted between 31 March 2009 and 5 April 2010, the points awarded are:

Qualification Points
Master's degree 35
PhD 50


There is no mention of Bachelor at all, even if when she previously claim for it on her application. She had no master degree, so she won't be able to extend. Anyone have a comment on this?

Extension is assessed under the rules in force on the date of application. ie: If the visa was granted points for a bachelors, extension points will be granted for the same.

Granted the UKBA wording is somewhat misleading, but this has been covered many times here.

I mean, how do they know that my friend applied under the old rule when her visa stamp was on the 9th May 2009?

They will have a record of the date of application.

simple just go to points b ased calculator , select extension applicant and then enter the dates , it will tell you ..

I do agree with skomati. If you enter the date in "Enter the date of your first successful tier 1 application" after 31 March 2009 you won't see the bachelors option in dropdown. But if the application date is before 31 March 2009 then you can still claim Bachelor points. My case is more secure in a sense that I got the visa stamp on 2 Feb, 2009 so my application date and visa stamp date both are before 31 March, 2009. But the date they are asking on their site is APPLICATION DATE and NOT VISA STAMP DATE.
