I am in Big Trouble!

Post by Howerd » Thu Apr 15, 2010 9:48 pm

My fiancee is due to come to UK from the Philippines to marry me but, in December last year, I reported a professional person to his regulatory body and Trading Standards and he is now suing me for £50,000 plus costs (probably £20,000 or more), saying that my reports were false.

If he wins, I will lose my house so, I am thinking of emmigrating to the Philippines instead of my future wife coming here. At least I can afford a house there even if I lose my house in UK.

Anyone any ideas of what I need to do visa-wise to move to Philippines and get married there? Can I get just one Visa, travel there, get married and live there?

Yes you can get a visa initially for 21 days during which time you can marry then extend your visa.
Finding work will be a big problem though

So, is there a Fiancée Visa, or do I just get a standard Visitor Visa? And if I get married in Philippines what is the likelihood of visa extension? Would I have to return to UK at any point in time?

I have about £50,000 in savings and that should see me through until retirement in 6 years time. My fiancée works. I am disabled too, so I doubt I can find work there.

Just all confused about what to do for the best. My fiancée is standing by me in whatever I decide to do but I cannot think straight at the moment; the court case is on Tuesday.

I don't think you need visa, you can stay there for 21 days visa free and extend if you want to stay longer. But bring a document something like certificate of non commitment or unmarried certificate. If you don't have this then you will have difficulty marrying your fiancee.

You can get a visa on entry at the airport and and you can ask your fiancee to arrange a date and time for your wedding at your local town hall which will be a lot easier and quicker than a church wedding. You need a certificate of non impediment and your fiancee needs to have the same.
You get a visa extension at immigration at Intramuros if you live in Manila or your nearest immigration office.
After one year of marriage your wife will be asked to attend an interview to ascertain if she still wants the marriage to continue and you will then be granted a further visa.
You do not have to return to the UK but you should make arrangements for your pension to be paid to you in the Philippines

Your fiancee/wife should be able to do all this for you

Also you can get a visa for the Philippines from the Philippine embassy in London if you want a longer visa than granted at the airport.
It also negates being hassled by corrupt officials in immigration for money to expedite your visa request quickly(fast track)

And I am speaking from experience, having been that route myself and I got married in the Philipiines.

The less you have to deal with Immigration in the Philippines the better.

They will extort you for as much as they can get as you are a foreigner.
This is what will happen if you go for 21 days visa on arrival.
You will try to update your visa as soon as possible and you will be told that there is a long queue but if you pay for express service it will be done the same day.
I was asked to pay an extra 8000 pesos, about £160 for fast tracking a visa

I found this site to be most helpful when I lived in the Philippines

Mochyn is correct about extending visa, money talks. So ask your fiancee if she knows someone at the immigration or let her ask someone who knows someone that knows anybody. That is if you are going the route of 21 days visa free.

Seems better to get Visa from embassy in UK for as long as possible. So, am I right in thinking there is no Fiancee Visa for Philippines? What is the longest visa I am likely to get and, once we are married, what would the next step in terms of visas/indefinite leave to remain etc? Or will I spend the rest of my life just getting temporary visas?

I did read the link, thanks!

But it does not answer the following questions...

1. Whether Philippines have specific Fiancee Visa?

2. The next steps to take after marriage in terms of marriage visa/idefinite leave to remain or do I have to keep applying for Visa extension every 59 days?

Once you are married to a Filipina you can apply for a visa called 13A, permanet resident visa for spouses of Philippine citizens. But I don't think this could lead to Phlippine citizenship. Just apply for regular visit visa.

Requirements

1. Notarized letter of application by the Filipino spouse
2. Accomplished and Notarized General Application Form (BI Form No. MCL-07-01)
3. NSO authenticated copy of the Filipino spouse’s birth certificate
4. NSO authenticated copy of the Marriage Contract (if married in the Philippines); or Philippine Embassy or Consulate authenticated copy of the Marriage Contract (if married abroad)
5. Bureau of Immigration (BI) Clearance Certificate
6. Photocopy of the foreign spouse’s passport showing the date of arrival and authorized period to stay
