Are persons holding Tier-2 (ICT) visa eligible?

Post by ILR2101 » Sat Apr 17, 2010 12:06 am

Friends,
Wanted to understand if persons holding Tier-2 (Intra Company Transfer) visa are eligible for settlement.
In the latest Set (0), I didn't find this category.
By the way, I have been on WORK PERMIT since July 2005 and in November 2009, when my WP was renewed, it came back as Tier-2 (ICT) as WP no longer exists.
Please let me know if I would be eligible for apply for ILR after 2 months (July 2010)?

Kind Regards!

A Tier 2 (ICT) is a tier 2 migrant, and you have Tier 2 migrant on the form.

i thought those on Tier 2 ICT are not eligible for settlement, I remember the ukba bringing this rule in around 2 years ago... I might be wrong but it's worth doing some reasearch.

Correct!
As per the new guidance/rules applicable 6th of April 2010. Tier 2(ICT) do not have right to settlement.

No, this is only for those getting their Tier 2 ICT AFTER April 2010. Let's appreciate that the government didn't change the rules for existing migrants this time.
Read #58 of this document.

Thanks Pierotts95!!

It quite clear from point 58 that anyone on erstwhile Work Permit and now Tier-2 (ICT) before 6 April 2010 are eligible for settlement as anyone else in Tier 1.

Thanks again for clarifying this with documents from UKBA.
