Tier 1 extension (Points based system Query)

Tier 1 extension (Points based system Query)

Hi,
I got my tier 1 approved last 5 months back before the new rules came in. I secured 40 points for my salary when I converted (Euros, the place I was working in ) to UK Pounds. My salary was in the range of 36,000 to 39,000 UK Pounds (ie 40 Points in old system).

Now I am working in UK for 34,000 pounds per annum. I saw the new system and could see that the points I could get are just 15 (according to new rules).

Is it that I wouldnt get extension after 3 years? I am bit worried about it as its said that we got to maintain the same while extension and extension would be granted again on points based system. Please help.

You will not be accessed according to new rules. When you apply for extension old rules apply to you.

TRANSITIONAL ARRANGEMENTS
15.
We are mindful of the impact that changes to the system can have on migrants who are already in the UK in Tier 1 (General) or one of its predecessors. Therefore we will put in place transitional arrangements to mitigate this impact.
16.
The new points table will not apply to migrants who are in the UK in one of the following immigration categories:
•
Tier 1 (General), with leave granted before 6 April 2010
•
The Highly Skilled Migrant Programme (HSMP)
•
Writers, Composers and Artists
•
Self-employed Lawyers

Thanks a lot. But still not clear. I am getting 34,000 UK Pounds per annum. Previosuly during application it was 36,000 UK pounds.
You had mentioned earlier rules would apply but If we consider my salary in UK now I wouldnt get 40 Points . It would be 20 may be. Hope I am clear.

If your salary is £34k you will get 35 points and 5 points for UK experience. See page 25 in the below link
