need advice on unmarried spouse visa

hi all,

we have decided that we will try to apply for an unmarried spouse visa (it's cheaper than tier 1 which I also qualify for).

we own a house together and i have been in the uk for 7 years (well, more than 10 years but i went back to my home country for 1.5 years in between).

The problem is that he is not fully divorced yet. he has applied for the decree nisi but not yet to the decree absolute. can I still apply for the unmarried visa as living with him for 2 years (the marriage broke down before we moved in together) or do I have to wait for 2 years after the absolute?

If you have been living together for at least two years, and can prove it, then yes, you can apply for an unmarried partner visa.

What sort of visa do you have at the moment? And when does that expire?

I'm on a work permit and it expires 5 march 2011.

I was on a student visa before the work permit.

edit: can we get married while i am on the unmarried partner visa? Will that affect anything?
