hi,
i have friend of mine who is UK citizen, her husband is foreigner. they have been married 5+ years. her questions:-
1) her husband wants to apply for tier1 general as he qualifying for the points. can he apply?
2) the UK citizen wife will still live abroad as she working in good paid job outside of UK. so can the husband apply for tier1?

the uk wife cant travel with her husband and live with him in UK since she is working outside of UK, that why the husband wants to apply for tier1 instead of settelement

If he qualifies under new rules of T1 General, then yes he can apply for it. He'll apply as main applicant and doesn't need to apply for his wife as a dependent.

2) the UK citizen wife will still live abroad as she working in good paid job outside of UK. so can the husband apply for tier1?

It's their personal decision whether they want to live together in UK or she wants to stay abroad. It won't make any difference on them as he's applying for Tier 1 General. Neither he's applying as her partner for settlement nor she's sponsoring him from within the country.
