Urgent: Dependent status while my Visa is being decided ?â€

Post by mail2panchal » Sat May 01, 2010 11:58 am

My Current Status: in UK ,
Currently holds : Tier 2 General.
Dependent holds: Tier 2 General Dependent.

Question: 1

I am applying my Tier 1 Visa (Switch from Tier 2 General) in June first week Only for me (Not for dependents).
If i am granted a VISA then i will process my dependent visa (After a month).

"If i get Tier 1 visa, What will be the status of my dependents visa (Still on tier 2 general dependent)," I am planning to apply for my dependents in July
and another question is , How long my dependent can stay (on Tier 2 dependents) after my visa (Tier 1)is granted ?
(If possible, Please give to the link for the rules to study related to the same)

Queston 2: How long it takes for the VISA if i am applying in person. (Assuming that all my documents are correct)

Question 3: If my Tier 1 is granted, Then my tier 2 remains valid ?

Hope i am clear about my questions. Thanks for your help in advance.

1. If you are granted Tier 1 leave to remain, your dependent(s) will need to apply for leave to remain as dependent(s) of Tier 1 migrant. Since your Tier 2 visa will not be valid any longer (when Tier 1 is granted), your dependents' Tier 2 visa should will also become invalid. Therefore, the change from Tier 2 dependent to Tier 1 dependent should be done at the earliest.

2. For a straightforward application, you should receive the visa on the same day (couple of hours).

3. No.

Appriciate your quick reply.

My question is " Should my dependent leave the coutry or How much time they can be here on tier 2 dependent after my tier 1"

What are the guidelines , How much time legally allowed for my dependents before i apply for them.

IMHO, they should apply for Tier 1 dependent leave to remain within 28 days of you being granted Tier 1 leave to remain OR leave the country within 28 days.

But don't take my word for it. It will be best to check with UKBA directly.
