Naturalisation & Fixed Penalty - SP50

Post by lionking007 » Fri Apr 30, 2010 7:43 pm

Hi

Last year I got 2 SP50 fixed penalty for exceeding temperory speed limit. I am due for Naturalisation very soon. Upon reading the AN guide, it mentions about minor offences

"You must give details of all criminal convictions both within or outside the United Kingdom. These include road traffic offences, but not fixed penalty notices which have not been given in a court. Fixed penalty notices include parking and speeding offences. Drink driving offences must be declared."

Do I still have to declare the SP50 speeding fines??????

Any help / advice on this matter will be greatly appreciated.

Many Thanks
LK

A fixed penalty is not a conviction and hence doesnt need to be mentioned anywhere on form AN.

If you didnt pay a fixed penalty, and subsequently went to court and got fined in court then this will have to be decalred on the form.

There is another point to be noted here. If you had more than one fixed penalty in last 12 months, then it will also be regarded as not meeting the good character requirement.

Cutting long story short, I have 2 SP50 (fixed penalty - not given in the court) both on M6 J4 within a week (1st speeding on 19 Feb 09 and 2nd ticket on 24 Feb 09)

I will be declaring it on the application form, Will it hamper my case for the citizenship?????

Any advice will be greatly appreciated.

Thank you

Since these were issued in 2009, there should be no affect. But do not forget to declare the same on form, if the form asks for such information.

I thought it was not necessary to declare a fixed penaltyas long as it was not given in court.

Tonytee is right but according to NCS you should declare it and it won't harm the application as long as it was not given in court.
