Residency requirements for Tier1 visa holders

Residency requirements for Tier1 visa holders

Hi folks,

Are there any residency requirements, specifically wrt maintaining phyiscal presence in UK, that haveo be maintained while the tier 1 visa holder a) is on Enter to remain status and b) on ILR status. I did not spot anything specific in the policy guidelines. It would be great if some experienced folks can shed some light on this topic.

there is guideline on how many days you're away from UK. others were able to elude this requirement due to work demand but other don't. read again here...

Still trying to get an answer for this one. Physical presense in UK, while on tier-1 status in UK, is still not clear to me. Please can anyone with experience on this issue comment on this.

There're no residency requirements for Tier 1.

As for ILR - Since you have, only today, received your Tier 1 visa, you'll be able to apply for probationary citizenship under earned citizenship laws (and not ILR), as and when you qualify . Details about absences from UK under earned citizenship laws are not yet known (not published).

Thanks for your prompt response here.

Just a little clarification here since am not sure i fully understand this. I get into UK, say August (visa start date) this year. And have my tier 1 extended from Aug 2012 to 2015. Once i am past this period, i understand that i needed to be on ILR for another year before applying for citizenship.

So are you saying that physical presence is not a requirement as long as i can meet the criteria, first for my tier 1 extension, and then subsequently for the ILR period (which is now probationary citizenship)?

For extension of Tier 1, there is no residential requirement. All you have to do is qualify for extension as per rules in force at the time of the (extension) application.

ILR and naturalization (citizenship), as they are applied for and granted, will change under earned citizenship laws. So you will apply for probationary citizenship and naturalisation according to the new laws and as per qualifying criteria applicable at the time of the application, not as per laws that are applicable today!
Guess, am going to deal with this later. Long time to go yet. One less thing to worry about.
